Box 558 <br /> Lodi, California 95240 <br /> Dear Mr. Bietz: <br /> NOTICE OF VIOLATION AND SCHEDULE FOR COMPLIANCE <br /> On June 5, 1986, the Department of Health Services (DHS) <br /> conducted an inspection of Lodi Metal Technology Inc. <br /> As a result of that inspection, violations of hazardous waste <br /> statutes and regulations were identified. <br /> Specific violation(s) and required corrective action are listed <br /> below. Failure to correct the identified violation(s) within the <br /> schedule provided will result in DHS citing you for <br /> continuing/additional violations. <br /> I. Schedule of Violations <br /> Violation # 1, Section 25191 (d) (2) Division 20 Chapter 6. 5 <br /> Health & Safety Code. <br /> Any person who knowingly does any of the following acts shall, <br /> upon conviction, be punished by a fine of not less than two <br /> thousand dollars ($2 , 000. 00) or more than fifty thousand dollars <br /> ($50, 000. 00) for each day of violation, or by imprisonment in the <br /> county jail not to exceed one year, or by both the fine and <br /> imprisonment. If the conviction is for a violation committed <br /> after a first conviction of the person under this section, the <br /> person shall be punished by imprisonment in the state prison for <br /> 16, 20 or 24 months, or in the county jail for not to exceed one <br /> year, or by a fine of not less than five thousand dollars <br /> ($5, 000. 00) or more than fifty thousand dollars ($50, 000. 00) per <br /> day of violation, or by both the fine and imprisonment. <br /> (1) Transports any hazardous waste to a facility which does not <br /> have a permit from the department issued pursuant to this <br /> chapter, or to any point which is not authorized according <br /> to this chapter. <br />
