Mr. Dalton Bietz -2- <br /> (2) Treats or stores any hazardous waste at a facility which <br /> does not have a permit from the department issued pursuant <br /> to this chapter, or at any point which is not authorized <br /> according to this chapter. <br /> Lodi Metal Tech Corp is operating a clarifier and a paint sludge <br /> treatment operation without a permit or variance from the <br /> Department. <br /> Violation #2 , Section 66480 (a) California Administrative Code. <br /> General Requirements for Manifest Use by the Generator. <br /> A generator who transports, or offers for transportation, <br /> hazardous waste for off-site treatment, storage or disposal shall <br /> prepare a manifest before transporting the waste off site. <br /> Lodi Metal Tech Corporation disposed of waste solvent through a <br /> company called Ultra Chem. This waste solvent was not <br /> manifested. <br /> Violation #3 , Section 66508 California Administrative Code. <br /> A generator may accumulate hazardous waste on site for 90 days or <br /> less without a permit or without having interim status provided <br /> that: <br /> (1) The waste is placed in containers and the generator complies <br /> with Article 24 as it applies to interim status facilities, <br /> or the waste is placed in tanks and the generator complies <br /> with Article 25 as it applies to interim status facilities <br /> except for Section 67258 . <br /> (2) The date upon which each period of accumulation begins is <br /> clearly marked and visible for inspection on each container. <br /> (3) While being accumulated on site, each container and tank is <br /> labeled or marked clearly with the words, "Hazardous Waste" , <br /> and the additional language as required under subsection (c) <br /> of this section. <br /> (4) The generator complies with the requirements for owners or <br /> operators in Articles 19 and 20 and Section 67105 . <br />
