If any discrepancies are fol,nd when thetics and rechecks have been <br /> Wde. Contractor shall report the discrepancies immediately to Constructor. Contractor shall use reasonable <br /> pCocautions to preserve Lines and ,grades. <br /> 4.2 MATERIALS AND WORLCtM SHIP: Katerials and workmanship shall be new, first class in every respect, plumb and <br /> true. and comply with requirements of the Specification and drawings. Work shall be subject to the Inspection of <br /> Constructor who will exercise control of the work to safeguard PG&E's interest. Contractor shall furnish Labor, <br /> natarials, equipment. and services required for the work unless otherwise specified. Work performed subsequent <br /> T_, '?+'*,,,•. to the award of the contract shall be performed In accordance with the contract. <br /> 4.3 TRADES; Various branches or trades into which the work is to be divided are described under separate <br /> divisions. Materials may be furnished and work performed in accordance with those divisions or otherwise at <br /> Contractor's option. Contractor shall, in accepting the bid of a subcontractor for a given trade or class of <br /> work. determine that the work to be performed by that trade Is Included In the subcontractor's bid. Whether or <br /> not specifically required within that division relAcLon to such trade or class of work. <br /> 4.4 ME's OPERATIONS: It is necessary that PC&E maintain its operations without interruption during the <br /> progress of the work; therefore, no unnecessary interference will be permitted. Neither the giving of special instructions by Constructor nor the adherence thereto by Contractor <br /> shall relieve Contractor of the sole responsibility to maintain safe and efficient working conditions. <br /> 3 LECAL RMQULtE:SNTS <br /> 5.1 PER.`iLTS AND RULES: Contractor shall, without additional cost to PG&E, obtain required pet^-its except for <br /> the general building permit, serve notices, arrange for Inspection, and pay fees and deposits. Work shall comply <br /> with applicable governmental rules, regulations, and ordinances. A general building permit wLLL be obtained by <br /> PG&E when required. <br /> 3.2 EQUIPMENT DESIGN: Equipment and material furnished hereunder shall he so designed and constructed that when <br /> LnstalLed they will comply:with the applicable laws, rules, and regulations. Lnciuding, without Limitation. <br /> "Occupational Safety and Health Standards" promulgated by the U.S. Secretary of Labor and those Safety Orders of <br /> the Division of Industrial Safety. Department of Industrial 'Relations, State of California, which must be <br /> complied with before the equipment and material may Lawfully be used by PC:&E in California. Expenses incurred Ln <br /> complying with these requirements are understood to be Included in the contract price. <br /> 5.3 CHANCE S: Requests by Contractor for any changes In the requirements of the Specification and drawings shall <br /> be brought to the attention of Constructor for written approvafsof Engineer. NO changes will be authorized <br /> without such approval. <br /> 5.4 BAND: If required by PC&E, Contractor shall furnish a surety bond securing performance of contract and <br /> payment of labor and material bills in the amount of 100. of the contract price. Contractor will be separately <br /> reimbursed for the actual premium cast thereof, <br /> 5.5 INFRINCE_MENT PROTECTION; Royalties or other charges for patents for machinery, equipment, or materials <br /> furnished by Contractor for the work, or for processes or arts employed by Contractor In the work, shall be <br /> considered as included In the contract price.
