No damages or extras will be allowed for unforeseen difficulties or <br /> obstructions. <br /> lI EQUAL OPPORTUNITY <br /> 12.I TUERAL REGULATIONS: During the performance of this contract and to the extent that Federal Equal <br /> Opportunity Regulations may be applicable to this contract the Contractor agrees [a comply with all provisions of <br /> those orders and regulations iaciuded by summary or reference is the following: <br /> 11.1.1 Equal Opportunity Agreement - Executive Order No. 11246 of September 24, 1965. (Contracts exceeding <br /> $10,000) Provides that Contractor will not discriminate against any employee or applicant for emplo++iaent <br /> because of rare. color, religion, sex, or national original and further that Contractor shall take <br /> affirmative action to ensure that applicant and employees are treated without regard to their race, color, <br /> religion, sex, or national origin. <br /> 11.1.2 Certification of Noosegregated Facilities - Subpart 1-12 803-10, Federal Procurement Regulations: - <br /> (Contracts exceeding $10,000) Contractor will not maintain or provide segregated facilities for his <br /> employees and will not permit his employees to perform their services at any Location, under his control, <br /> where segregated facilities are maintained. <br /> 11.1.3 Listing Employment Openings - Executive Order No. 11701: (Contracts of $2,500 or more) Contractor <br /> will list employment openings with the Employment Development Department in accordance with the Veteran's <br /> Employment and Readjustment Act of 1972 and Executive Order No. 11701. The contract clause, set forth at <br /> 41CFRi 0-250.2 is incorporated herein by reference. <br /> 11.1.4 Utilization of Minority Enterprises - Executive Order No. 11615. (Contracts exceeding 55,000) It is <br /> the policy of the Government that Minority Business Enterprises shall have the maximum practicable <br /> opportunity to participate in the perform-ace of Govern-eat contracts. The Contractor agrees to use his <br /> best efforts to carry out this policy is the award of his subcontracts to the fullest extent consistent with <br /> the efficient performance of this contract. <br /> 11.1.5 employment of the Handicapped - Section 741.3, Rehabilitation Act of 1973: (Contracts exceeding <br /> $2.500) The affirmative action clause and the regulations contained in Part 741 of the Rehabilitation Act of <br /> 1973 are incorporated by reference in this Contract. <br /> 11.1.6 Filing EEO-1 Forms and Preparing Affirmative Action Plans: (Contracts of $50,000 or more) If the <br /> value of this contract is 550,000 or more and the Contractor has 50 or more employees the Contractor agrees <br /> to file appropriate EEO-1 forms in accordance with existing regulations and maintain a current written <br /> affirmative action compliance program at each establishment at which Contractor has 50 or more employees. <br /> 11.1.7 Vietnam Era Veterans Readjustment Assistance - Act of 1974, Title 41, Chapter 60, Part 250: <br /> (Contracts of $10,000 or more) The affirmative action clause and the regulations pertaining to the <br /> employment of disabled veterans and veterans of the Vietnam Era are incorporated by reference in this <br /> contract. <br /> 11.2 PG&E's POLICY: It is PG&E's policy that minority and women-owned businesses shall have the maximum <br /> practicable opportunity to participate in providing PGS$ with the products and services it purchases.
