Violating Health and Safety Code section 25503.5(a), being a business that handles <br />a hazardous material or a mixture containing a hazardous material that has a quantity at any one time <br />during the reporting year equal to, or greater than, a total weight of 500 pounds, or a total volume of <br />55 gallons, or 200 cubic feet at standard temperature and pressure for compressed gas, failing to <br />establish and implement a business plan for emergency response to a release or threatened release of <br />a hazardous material for 2498 E. MAIN ST., 48 E. CHARTER WAY, 340 N. WILSON WAY, <br />STOCKTON, CALIFORNIA and 400 E. LODI AVE., LODI, CALIFORNIA; <br />b. Violating Health and Safety Code section 25504(b), business plan failing to include <br />emergency response plans and procedures in the event of a reportable release or threatened release of <br />a hazardous material, including but not limited to the following: <br />1. Immediate notification to the San Joaquin County Office of Emergency <br />Services and to the appropriate local emergency rescue personnel; <br />2. Procedures for the mitigation of a release or threatened release to minimize <br />any potential harm or damage to persons, property, or the -environment; <br />business site; <br />3. Evacuation plans and procedures, including immediate notice, for the <br />c. Violating Health and Safety Code section 25504(c), failing to train all new <br />employees and annual training, including refresher courses, for all employees in safety procedures in <br />the event of a release or threatened release of a hazardous material, including, but not limited to, <br />familiarity with the plans and procedures specified in Health and Safety Code section 25504(b); <br />d. Violating Health and Safety Code section 25505, failing to submit a business plan <br />for emergency response to a release or threatened release of hazardous material for the year 2007 for <br />2498 E. MAIN ST., 48 E. CHARTER WAY, 340 N. WILSON WAY, STOCKTON, CALIFORNIA <br />and 400 E. LODI AVE., LODI, CALIFORNIA, to the San Joaquin County Office of Emergency <br />Services. Further, it is alleged that said violation was knowingly committed after reasonable notice; <br />e. Violating Health and Safety Code section 25505(e)(2), failing to annually submit a <br />form, provided by the San Joaquin County Office of Emergency Services, that certifies that the <br />PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
