Defendant with actual or constructive knowledge of this Injunction, only in so far as they <br />4 are doing business in the State of California, in the course of Defendant's TIRE DEALER activities, <br />5 are pursuant to California Business and Professions Code, section 17204 hereby permanently <br />6 enjoined from: <br />7 a. Violating Health and Safety Code section 25100 et seq., as described in paragraph <br />8 3 - 3g above; <br />9 b. Violating Health and Safety Code section 25280 et seq., as described in paragraph <br />10 4 - 4a above; <br />11 c. Violating Health and Safety Code section 25500 et seq., as described in paragraph <br />12 5 - 5e above; <br />13 d. Failing to ensure appropriate Fire Prevention Measures for waste tire facility, in <br />14 violation of California Code of Regulations, title 14 section 17351; <br />15 e. Failing to maintain appropriate Vector Control Measures for waste tire storage <br />16 facility, in violation of California Code of Regulations, title 14 section 17353; <br />17 f. Failing to follow required procedures for the storage of waste tires outdoors, in <br />18 violation of California Code of Regulation, title 14 section 17354; <br />19 g. Failing to submit a completed waste tire facility permit application to the Board, in <br />20 violation of California Code of Regulation, title 14 section 18423; <br />21 h. Failing to apply for and obtain a California Integrated Waste Management Board <br />22 assigned Tire Program Identification Number for each location, in violation of California Code of <br />23 Regulations, title 14 section 18459.1; <br />24 i. Failing to maintain waste tire manifest system requirements for waste tire haulers at <br />25 all facilities, in violation of California Code of Regulations, title 14 section 18460.2; <br />26 j. Failing to maintain manifest system requirements for waste tire end-use facilities at <br />27 all facilities, in violation of California Code of Regulations, title 14 section 18461; <br />28 k. Failing to maintain manifest system requirements for waste tire generators at all <br />4 <br />PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
