McKinley Avenue
Lathrop, CA 95330
Dear, Mr . Arp:
Pursuant to our telephone conversation of April 24, I have
rechecked the violations alleged in the complaint you were served
with on April 19 . There is an error on page three, line 13, it
should read "16177 South McKinley Avenue, Lathrop" .
The Air Pollution District has no record of receiving payment
with the application for the cyclone received 12/13/88.
Therefore no permit has ever been issued for the cyclone. A
permit is also required for your paint operation and the Air
Pollution District has never indicated otherwise.
You may be confusing the Air Pollution District with the
Department of Health Services, who inspected your facility last
year to determine if hazardous waste was being generated. Joe
Franz of Department of Health Services determined no hazardous
waste permits were necessary. It was to that Department that
Gliddon Paint Company sent information.
You should contact an attorney immediately. You were served on
April 19 and must file an answer by May 19. If an answer or other
responsive pleading is not filed by that date, we will seek a
default judgment for the entire amount sought by the complaint.
No extensions on time to answer have been given or will be.
If you intend to remove the cyclone, you must first get approval
from the local fire department for whatever sawdust collection
system you replace it with. -
Sincerely,
OFFICE OF THA DISTRICT ATTORNEY
L S F.
