There was a permit and the permit#was SR0032551. Mr. Shih also discovered the well destruction was sub-contracted to Clark Well. Mr. Swesy had no knowledge that a permit was required to remove this UST. Mr. Benjamin phoned and provided the EPA ID number (CAC0002561721), and stated that he had sub-contracted to Richard Lowry of nt Georas g Lo r , In ., toBenj remove this UST. A notice to abate immediately(NAI) ( 4) n. On March 13, 2003, a letter was mailed to Ms. Simpson, City of Tracy, Community Preservation Manager,to recommend that an assessment be performed prior to future development (attachment 5). On March 15, 2003, a faxed report (attachment 6)was received from George W. Lowry, Inc. The report summarized the tank removal and included the paperwork for removal. On March 20,2003, a letter(attachment 7)was mailed to both Mr. Benjamin and Mr. Richard Lowry of George W. Lowry, Inc. to clarify the statement: "Approved as a Farm Tank by Doug Wilson..." on the report dated March 15,2003. This office did not approve the UST as a farm tank. On April 10, 2003, Mr. Shih received a faxed copy of the proposal for a permit application and soil sampling collection from Mr. Danny Benjamin. On May 6, 2003, the permit to remove the UST was approved (Attachment 8). On May 30, 2003,Mr. Shih witnessed the soil sampling. On August 6, 2003, the clean letter(Attachment 9)was issued based on the worksheet for site closure evaluation(Attachment 10) of soil sample analytical results (Attachment 11). II. NARRATIVE DATE ACTIVITY ACTION RECORDED BY 02/10/03 Received Compliant stating that an Underground Storage Tank(UST)had been SCS removed illegally this date around 12 to 13 PM at 90 Mt.OSO Tracy. I arrived on site meeting Kerry Simpson(City of Tracy Community Preservation Manager), Pat Zona(City of Tracy,Code Enforcement),Mark Mehring(City of Tracy,Fire Department)and Mark Richardson(City of Tracy,Fire Department). There was an approximately 300—400 Gallon UST sitting on East site of this property. Neighbor(Mr.&Mrs.Pennell)told me that this tank was removed around noon today by W.C.Maloney. W.C.Maloney removed the tank from underground and backfill the hole and put the removed tank on the same location. There are two --Y'openings and one—1"openings on top of the tank. There was some liquid with hydrocarbon smell inside the tank. There is no sign of spillage around the tank. In addition,there is an abandoned well sitting on middle of the property about 140 South of the street. The sanitary seal is not proper secured,and there are holes around the decayed steel casing.
