As time progressed, we thought that we ripeded to <br /> do our do-diligence to ourselves and check the site on Pacific <br /> Avenue and again we discovered a contamir►ation problem. <br /> I am at a point now that I cannot afford to put any mor (- money <br /> into a project of this magnitude. It has financially crippled <br /> me. I have applied for the "Underground Storage Cleanup Fund". <br /> If I should end up with the property or should Mr. Shaughnessy <br /> end up with the property, at least one of us would have state <br /> assistance if approved by the state. I will need as much <br /> assistance from your__-y_our office_,_ and all county aria state <br /> regulatory offices as possible to acquire the Cleanup Fuad money. <br /> At this point, Mr . Shaughnessy has been unw.illiliq and <br /> uncooperative to do what is best for the environment and this <br /> situation. <br /> As you have expressed in several of our phone conversations over <br /> the last month, during the course of your working career in the <br /> field that you are in, you have never seen a dip stick puncture a <br /> hole in the bottom of a tank. With this in mind and the <br /> discoveries that we have made, and the information that Mr. <br /> Shaughnessy shared with ire about the electrolysis that ocurred on <br /> both locations, this contamination problem has been here for <br /> years. During the short course of time drat we operated the Miner <br /> Street location we were never able to achieve an accurate or a <br /> consistent reading on our morning and evening readings. We have <br /> never had any discrepancies in our fuel r eadirigs at our location <br /> in Modesto. I feel that we have an under standing of the <br /> importance of an accurate reading. <br /> r <br /> At this point I arra personally without fund=T to d(--i any more than <br /> close one or both locations and to stay In c.r_,.mplianc.e with your <br /> department. I would like to apply for n ter11p0�1al-y clrlsure Of the <br /> underground storage tanks at. this time until it is deetprmined <br /> what must be done, and how it is to be paid fox-. We have a court <br /> date at this time for September- 1G, 1992 to try and resolve the <br /> matter of who the contamination belongs to. We also have a court <br /> order not to remove or sell anything from either of these <br /> properties.
