All Repeat Violations 22. Documented on work order 21336 from Walton Engineering on 10/19/09 during the Monitoring System Certification testing, "Dispenser 14 has a severe leak. Removed approximately 5 gallons of fuel from the UDC". Documented on work order 23108 from Walton Engineering on 12/21/09, "115 fuel alarm for UDC 14 on diesel island fuel in bottom of pan removed diesel from pan put waste in sold HAZ MAT drum, alarm cleared checked pumps 13 14 15 and found leaky valve for dispenser 15 satellite in UDC 14 and will need to replaced. Put 15 satellite out of service til valve can be replaced all function normal at Veeder Root." These releases were not reported to the EHD within 24 hours and a full Reportable Release Report was not submitted to the EHD within five working days. Any release from the primary containment that does not escape the secondary containment and was not cleaned up within eight hours of detection, or any release that escapes the secondary containment shall be reported to the EHD within 24 hours and a full Reportable Release Report shall be submitted within five working days. Reportable Release Report information must include: 1. Owner's/operator's name & telephone number, 2. List of types, quantities, and concentrations of hazardous substances released, 3. Approximate date of release, 4. Date release was discovered, 5. Date release was stopped, 6. Description of actions taken to control and stop the release, 7. Description of corrective and remedial actions, 8. Methods of clean up implemented to date, and proposed clean up actions with a time schedule, 9. Method and location of disposal of waste generated from release and clean up. Attach copies of any hazardous waste manifests. 10. Description of proposed methods of repair or replacement of primary or secondary containment, 11. Description of additional actions taken to prevent future releases. Immediately prepare a report with the required information and submit a copy to the EHD. Ensure that any future releases are reported appropriately. 22. All diesel dispenser pans and Diesel North and South STP sumps have what appears to be diesel fuel. Any unauthorized release from primary containment which UST operator is able to clean up within 8 hours after the release was detected or should be detected, and which does not escape from secondary containment, does not increase the hazard of fire or explosion, and does not cause any deterioration of secondary containment, must be recorded in facility's monitoring plan. Report information must include: 1. Owner's/operator's name & telephone number, 2. List of types, quantities, and concentrations of hazardous substances released, 3. Description of actions taken to control and stop the release, 4. Method & location of disposal of hazardous substance. Attach copies of any hazardous waste manifest. 5. Description of proposed methods of repair or replacement of primary or secondary containment, 6. Description of additional actions taken to prevent future releases. A copy of Recordable Release Report must be submitted to SJC EHD by 11/29/10 if clean up is within 8 hours ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTE DATES WI BE BILLED AT THE CURRENT HOURLY RATE(YI22).
