RESOLI TION IVO. 16-408 A RESOLUTYON OF TWE LATHROP CITY COUIVCIL APPROVIfVG AND CERTIFI(ING THE EIV!/IROIVMIENT L IMPACT ItEPORT (SCFi #20151020C2), CEQA FINDINGS OF FACT, STATEMEINT OF OVERQtIDINC CONSIDERATIONS IVD MITIC;ATIONS MEA URES/MONITORING PLAN FOR TEiE PILOT FLYING J YotAVEL CE11’I ER; APPRO\4ING THE PILOT FLYING J Tlt/VEL CEIVTER SI E PLAIV REVI W D#TED SEPTEN9 E1 22, 2015; 14iVD, APPItOVIfVC THE PILOT LYINC9 7 T VEL CEfVTEIt CONDITIONAL 11SE PERMITo WHEREAS, the City of Lathrop City Council held a duly noticed public hearing on June 6, 2016, to consider the Environmental Impact Report (EIR), CEQA Findings of Fact, Statement of Overriding Considerations and Mitigation Measures/Monitoring Reporting Plan (SCH #2015102062) prepared for the Lathrop Pilot Flying J Travel Center and associated entitlements, including Zoning Map Amendment, Annexation for a 27.65-acre project area of which 3.15 acres are made up of contiguous properties, Conditional Use Permit, Site Plan Review; and WHEREAS, in accordance with Public Resources Code Section 21000 et. seq. and State CEQA Guidelines Section 15000 et. seq., the City of Lathrop prepared and circulated for a 45-day public review period a Draft Environmental Impact Report DEIR) for Lathrop Pilot Flying J Travel Center, dated February 25, 2016 (incorporated by reference herein) and ending April 10, 2016, that evaluated the potential environmental effects of the proposed Lathrop Pilot Flying J "Project"; and WHEREAS, the City of Lathrop distributed copies of the DEIR to State Office of Planning and Research (OPR/State Clearinghouse), interested and responsible public agencies, and other interested persons and sought the comments of such agencies and persons; and IVHERE IS, the City of Lathrop received three (3) written and verbal communications and/or comments on the DEIR and responses to those comments were prepared in the form of the Final Environmental Impact Report (FEIR), dated April 2016 incorporated by reference herein); and WHERE S, the City of Lathrop distributed copies of the DEIR to State Office of Planning and Research (OPR/State Clearinghouse), interested and responsible public agencies, and other interested persons and sought the comments of such agencies and persons; and IVHEREAS, the City of Lathrop provided notice regarding the availability of and mailed copies of the FEIR with proposed responses to comments to all public agencies and persons submitting comments on the DEIR; and Resolution No. 16-4088 Page 1 of 4
