WHEREAS, the City of Lathrop Planning Commission held a duly noticed public <br />hearing on May 11, 2016, to consider the Environmental Impact Report (EIR), CEQA <br />Findings of Fact, Statement of Overriding Considerations and Mitigation <br />Measures/Monitoring Reporting Plan (SCH #2015012062) prepared forthe Lathrop Pilot <br />Flying ] Travel Center and associated entitlements, including Zoning Amendment, <br />Annexation for a 27.65-acre project area of which 3.15 acres are made up of <br />contiguous properties, Conditional Use Permit, Site Plan and after reviewing and <br />considering all information provided and submitted, and after taking and considering all <br />public testimony adopted Resolution No. 16-05 recommending City Council approval of <br />the EIR and associated entitlements; and <br />1NHEREAS, the City of Lathrop Planning Commission held a duly noticed public <br />meeting to consider the Site Plan Review request pursuant to the Lathrop Municipal <br />Code; and <br />WHEREAS, the request is for a Site Plan Review to construct a Truck Travel <br />Service Center and fueling station; and <br />WHEREAS, the property is located at 10998 Harland Road (APN: 193-330-30); <br />and <br />WHEREAS, the subject parcels are located in a Freeway Commercial (FC) <br />General Plan designation and Highway Commercial (CH) Zoning District; and <br />WHEREAS, the Planning Commission found that the proposed Pilot Flying J <br />Travel Center is consistent with the Freeway Commercial land use goals and policies the <br />City of Lathrop General Plan. The proposed project complies with all applicable <br />provisions and standards for the Highway Commercial Zoning designation as <br />conditioned; and <br />WHEREAS, the Planning Commission found that the requirements and <br />conditions of this resolution are reasonable in preserving, protecting, providing for, and <br />fostering the health, safety, and welfare of the citizenry in general, and the persons <br />who work in or visit the development in particular; and <br />WHEREAS, the City of Lathrop Planning Commission held a duly noticed public <br />hearing on May 11, 2016, to consider the Pilot Flying ] Travel Center Site Plan Review <br />No. 15-56, dated September 22, 2015, and after taking and considering all public <br />testimony adopted Resolution No. 15-06 recommending City Council approval of the <br />Pilot Flying J Travel Center Site Plan Review; and <br />WHEREAS, the applicant has requested a Conditional Use Permit for a 9.17 acre <br />portion of a 24.5 acre site proposed for a Pilot Flying J Travel Center to be comprised of <br />13, 011 square foot retail center, 9 diesel fueling lanes,l2 gas fueling lanes, truck and <br />vehicle parking as well as landscape and various other site improvements; and <br />WHEREAS, the City of Lathrop Planning Commission held a duly noticed public <br />meeting on the proposed Conditional Use Permit request pursuant to the Lathrop <br />Municipal Code; and <br />Resolution No. 16-4088 Page 2 of 4
