WHEREAS, the Planning Commission found that the proposed travel center is <br />consistent with the Freeway Commercial land use goals and policies of the City of <br />Lathrop General Plan. The proposed use is also consistent with the standards for the <br />Highway Commercial Zoning designation as conditioned; and <br />WHEREAS, the Planning Commission found that the requirements and <br />conditions of the approved resolution are reasonable in preserving, protecting, <br />providing for, and fostering the health, safety, and welfare of the citizenry in general, <br />and the persons who work in or visit the development in particular; and <br />WHEREAS, the City of Lathrop Planning Commission held a duly noticed public <br />hearing on May 11, 2016, to consider the Conditional Use Permit for the Pilot Flying J <br />Travel Center and after taking and considering all public testimony adopted Resolution <br />No. 16-08 recommending City Council approval of the Conditional Use Permit; and <br />WHEREAS, the City Council has independently reviewed and considered all <br />written evidence and oral testimony presented to date, including the Environmental <br />Impact Report (consisting of the DEIR and FEIR) prepared for the Pilot Flying ] Travel <br />Center and associated entitlements, City staff reports and all information received at <br />the duly noticed public hearings, all of these documents and evidence of which are <br />incorporated in the record herein by reference; and <br />WHEREAS, proper notice of this public meeting was given in all respects as <br />required by law; and <br />WHEREAS, the City Council has utilized its own independent judgment in <br />adopting this Resolution. <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of <br />Lathrop does hereby Approve and Certify the Environmental Impact Report (consisting <br />of the DEIR and FEIR), CEQA Findings of Fact, Statement of Overriding Considerations, <br />and Mitigation Measures Monitoring Plan for the Pilot Flying J Travel Center prepared for <br />the project and associated entitlements as illustrated in the City Council Staff Report of <br />une 6, 2016 as Attachments G and H and incorporated herein by this reference; <br />subject to the "CEQA Findings of Fact and Statement of Overriding Considerations" as <br />illustrated in the City Council Staff Report of ]une 6, 2016 as Attachment I and <br />incorporated herein by this reference; Approve the Pilot Flying J Travel Center Site Plan <br />Review plans dated September 22, 2015 as illustrated in the City Council Staff Report <br />of ]une 6, 2016 as Attachment E and incorporated herein by this reference; and, <br />Approve the proposed Conditional Use Permit related to the Pilot Flying J Travel Center <br />as illustrated in the City Council Staff Report of]une 6, 2016. <br />Resolution No. 16-4088 Page 3 of 4
