WHEREAS, the Planning Commission found that the proposed travel center is consistent with the Freeway Commercial land use goals and policies of the City of Lathrop General Plan. The proposed use is also consistent with the standards for the Highway Commercial Zoning designation as conditioned; and WHEREAS, the Planning Commission found that the requirements and conditions of the approved resolution are reasonable in preserving, protecting, providing for, and fostering the health, safety, and welfare of the citizenry in general, and the persons who work in or visit the development in particular; and WHEREAS, the City of Lathrop Planning Commission held a duly noticed public hearing on May 11, 2016, to consider the Conditional Use Permit for the Pilot Flying J Travel Center and after taking and considering all public testimony adopted Resolution No. 16-08 recommending City Council approval of the Conditional Use Permit; and WHEREAS, the City Council has independently reviewed and considered all written evidence and oral testimony presented to date, including the Environmental Impact Report (consisting of the DEIR and FEIR) prepared for the Pilot Flying ] Travel Center and associated entitlements, City staff reports and all information received at the duly noticed public hearings, all of these documents and evidence of which are incorporated in the record herein by reference; and WHEREAS, proper notice of this public meeting was given in all respects as required by law; and WHEREAS, the City Council has utilized its own independent judgment in adopting this Resolution. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lathrop does hereby Approve and Certify the Environmental Impact Report (consisting of the DEIR and FEIR), CEQA Findings of Fact, Statement of Overriding Considerations, and Mitigation Measures Monitoring Plan for the Pilot Flying J Travel Center prepared for the project and associated entitlements as illustrated in the City Council Staff Report of une 6, 2016 as Attachments G and H and incorporated herein by this reference; subject to the "CEQA Findings of Fact and Statement of Overriding Considerations" as illustrated in the City Council Staff Report of ]une 6, 2016 as Attachment I and incorporated herein by this reference; Approve the Pilot Flying J Travel Center Site Plan Review plans dated September 22, 2015 as illustrated in the City Council Staff Report of ]une 6, 2016 as Attachment E and incorporated herein by this reference; and, Approve the proposed Conditional Use Permit related to the Pilot Flying J Travel Center as illustrated in the City Council Staff Report of]une 6, 2016.
