The Applicant shall pay a reimbursement fee to the I-5 Logistics project for the fair share portion <br />of the force main cost which carries wastewater flow from 11800 Harlan Rd to the Stonebridge <br />collection system. <br />7. Applicant shall underground all overhead utilities in compliance with the Lathrop Municipal Code. <br />Overhead power lines in excess of 34.5 KVA are not required to be underground. <br />8. Applicant shall be required to install full street frontage improvements along the Roth Road frontage <br />adjacent to the Pilot project, and guarantee full street frontage improvements on the balance of Roth <br />Rd and Harlan Road, along the full frontage of 10998 Harlan Road (APN 196 -330-30) including <br />but not limited to curb, gutter, sidewalk, street trees, landscape, street lights, hydrants, storm sewer, <br />paving and striping. The extent of paving shall include one half street width to the center line of <br />Roth Road and Harlan Road along the frontage of 10998 Harlan Road (APN 196-330-30). The City <br />Engineer is recommending and shall have the authority to defer construction of street improvements <br />with a Deferred Frontage Improvement Agreement beyond the frontage of the Pilot project. <br />9. The Applicant shall dedicate or make an irrevocable offer of dedication for the ultimate right-of- <br />way width of Roth Road and for a ten (10) foot public utility easement along the full frontage of <br />Roth Rd and Harlan Rd for 10998 Harlan Road (APN 196-330-30). The City Engineer shall have <br />the authority to incorporate the offers of dedication into a Deferred Frontage Improvement <br />Agreement. <br />10. The Applicant shall obtain an encroachment permit for all offsite work. <br />11. The Applicant shall pay its fair share toward improvements to the McKinley Avenue / Roth Road <br />intersection. The project’s fair share traffic contribution to these improvements is projected to be <br />eight (8) percent of the total cost of signalizing this current side-street stop controlled (SSSC) <br />intersection. As an alternative, the Lathrop traffic mitigation fees may be amended to include a <br />traffic signal at the McKinley Avenue/Roth Road intersecti on, and payment of the mitigation fee <br />would mitigate this impact. The following mitigation measures would be necessary to provide <br />acceptable operations: <br />a. Install traffic signal control at the intersection. An evaluation of all applicable signal <br />warrants should be conducted and additional factors (e.g., congestion, approach <br />conditions, driver confusion) should be considered before the decision to install a signal <br />is made <br />12. The Applicant shall pay its fair share toward the widening of Roth Road. The project shall include <br />the addition of a two-way left turn median in the center of Roth Road for vehicles entering and <br />exiting the project site. The current mandate for 6 lanes on Roth Rd was based upon indications that <br />the County intended to extend Roth east to connect with State Route 99. The County has since <br />changed their plans and will not extend Roth Road. The City anticipates it will amend the General <br />Plan Circulation Element to reduce Roth from 6 lanes down to 4 lanes in the near future. <br />13. The City Engineer shall determine the fair share of costs consistent with the City’s General Plan <br />Circulation Element, including a subsequent amendment to reduce Roth from the anticipated 6 lanes <br />down to 4 lanes in the near future. <br />14. Applicant shall pay all appropriate fees including but not limited to the North Lathrop <br />Transportation Fee, Capital Facilities Fees, San Joaquin County Regional Traffic Impact Fee <br />(RTIF), and Plan Check and Inspection Fees. <br />15. Applicant shall provide driveway access to the site as well as on-site circulation capable of safely <br />accommodating an STAA size truck.
