Title 22, CCR 66265.31 Facility not maintained to minimize the release of <br />hazardous waste. Facilities shall be maintained and operated to minimize the <br />possibility of a fire, explosion, or any unplanned sudden or non -sudden release of <br />hazardous waste or hazardous waste constituents to air, soil, or surface water which <br />could threaten human health or the environment. <br />4 Fuel staining was observed on the ground around the diesel dispensers at the <br />Manteca facility during the April 7, 2005, routine hazardous waste inspection. <br />Title 22, CCR 66265.32 (c) Spill control equipment, and/or decontamination <br />equipment not provided. All facilities shall be equipped with the following, unless it <br />can be demonstrated to the Department that none of the hazards posed by waste <br />handled at the facility could require a particular kind of equipment specified below: <br />(a) an internal communications or alarm system capable of providing immediate <br />emergency instruction (voice or signal) to facility personnel; <br />(b) a device, such as a telephone (immediately available at the scene of operations) or a <br />hand-held two-way radio, capable of summoning emergency assistance from local <br />police departments, fire departments, or State or local emergency response teams; <br />(c) portable fire extinguishers, fire control equipment (including special extinguishing <br />equipment, such as that using foam, inert gas, or dry chemicals), spill control <br />equipment, and decontamination equipment; and <br />(d) water at adequate volume and pressure to supply water hose streams, or foam <br />producing equipment, or automatic sprinklers, or water spray systems . <br />A container to hold hazardous waste was not found at the Tracy facility during <br />the October 19, 2004, routine hazardous waste inspection <br />Title 22, CCR 66265.35 Failed to maintain adequate aisle space. The owner or <br />operator shall maintain aisle space to allow the unobstructed movement of personnel, <br />fire protection equipment, spill control equipment, and decontamination equipment to <br />any area of facility operation in an emergency, unless it can be demonstrated to the <br />Department that aisle space is not needed for any of these purposes. <br />4 Junk and trash were found at the Tracy facility piled around the actively used <br />hazardous waste container, restricting access, during the April 3, 2008, routine <br />hazardous waste inspection <br />Title 22, CCR 66265.173 (a) Failed to keep containers of hazardous waste closed <br />except when adding or removing hazardous waste. A container holding hazardous <br />waste shall always be closed during transfer and storage, except when it is necessary to <br />add or remove waste. <br />4 A 55 -gallon container was open and not in use at the Manteca facility during the <br />April 7, 2005, routine hazardous waste inspection. <br />—> A 55 -gallon container was open and not in use at the Tracy facility during the <br />April 3, 2008, routine hazardous waste inspection. <br />Title 22, CCR 66266.130 (c)(3) Failed to label used fuel filters. The drained used oil <br />filters are accumulated, stored, and transferred in a closed, rainproof container that is <br />capable of containing any used oil that may separate from the filters placed inside. <br />Drums of used oil filters shall be sealed during transfer so that used oil will not spill out <br />when they are laid upon their sides. Drums shall be secured as a load to prevent <br />movement or tipping during transfer. Containers shall be labelled as "drained used oil <br />filters" (not as hazardous waste) and show initial date of accumulation or receipt on each <br />container of filters. <br />12 <br />
