Underground Storage Tank Violations <br />HSC 25284.2 Annual spill containment testing. The owner or operator of an <br />underground storage tank with a spill containment structure designed to prevent a <br />release in the event of a spill or overfill while a hazardous substance is being placed in <br />the tank shall annually test the spill containment structure to demonstrate that it is <br />capable of containing the substance until it is detected and cleaned up. <br />4 Spill container testing at the Manteca facility was performed fourteen months <br />late on November 8, 2005. <br />4 Spill container testing at the Manteca facility was performed four months late <br />on March 9, 2007. <br />4 Spill container testing at the Tracy facility was performed three months late on <br />March 28, 2007. <br />4 Spill container testing at the Manteca facility was performed two months late on <br />May 8, 2008. <br />HSC 25292.2 Certification of financial responsibility and CFO letter. <br />(a) All owners and operators of an underground tank system shall maintain evidence of <br />financial responsibility for taking corrective action and for compensating third parties <br />for bodily injury and property damage caused by a release from the underground <br />tank system, in accordance with regulations adopted by the board pursuant to <br />Section 25299.3. The regulations shall include a schedule that requires that financial <br />responsibility requirements are phased -in for all underground storage tank systems <br />on or before October 26, 1990. <br />(b) If the owner and the operator are separate persons, either the owner or the operator <br />shall demonstrate compliance with subdivision (a). <br />(c) An owner may comply with this article by entering into an agreement with the <br />operator of the tank requiring the operator to demonstrate compliance with <br />subdivision (a). However, both the owner and the operator are in violation of <br />subdivision (a) if evidence of financial responsibility is not established and <br />maintained in accordance with this article. <br />4 A current copy of the financial responsibility documents for the Manteca facility <br />was not on file with this office at the time of the March 9, 2007, and May 8, 2008, <br />routine UST inspections. <br />4 A current copy of the financial responsibility documents for the Tracy facility <br />was not on file with this office at the time of the October 19, 2004, March 13, 2007, <br />and April 3, 2008, routine UST inspections. <br />Title 23, CCR 2632 (b) Monitoring Program (Monitoring & Response Plan) is <br />current and approved by the local agency. Owners or operators of underground <br />storage tanks subject to this section shall implement a monitoring program approved by <br />the local agency and specified in the underground storage tank operating permit. The <br />program shall include interstitial space monitoring as described in subsection (c) and <br />shall include the items listed in subsection (d). <br />4 The monitoring and response plans on file with this office for the Tracy facility <br />were not current during the April 3, 2008, routine UST inspection. <br />15 <br />
