Any <br />person who generates a waste shall determine if the waste is a hazardous waste. Immediately stop recycling metal <br />fines, make a hazardous waste determination for the brake shavings , and manage it according to Title 22 hazardous <br />waste regulations. Particles 100 microns or smaller must be handled as hazardous waste if the metal is determined <br />to be a hazardous waste. Submit a statement and supporting documentation explaining how this waste was <br />managed. <br />This is a minor violation. <br />403 <br />CCR 66265.173 Failed to keep hazardous waste containers closed except when adding or removing hazardous waste. <br />A blue 30 gallon drum of used waste absorbent and metal brake shavings on the north west side of the shop was open <br />. All hazardous waste containers shall be closed at all times except when adding or removing waste. Immediately <br />close these containers and ensure all hazardous waste containers are closed when not adding or removing waste. <br />This is a minor violation. <br />501 <br />CCR 66265.192(a) Failed to comply with new hazardous waste tank system assessment requirements. <br />Facility does not have a tank assessment for review for the 570 gallon waste oil tank and the 330 gallon waste <br />antifreeze tank. The owner or operator of a hazardous waste tank shall obtain a written assessment reviewed and <br />certified by an independent, qualified, professional engineer, registered in California attesting that the system has <br />sufficient structural integrity, is acceptable for the transferring, storing, and treating of hazardous waste, and that the <br />tanks and containment system are suitably designed. Immediately have an assessment prepared for the 570 gallon <br />waste oil tank and the 330 gallon waste antifreeze tank.
