I referred to as Defendant,their subsidiaries and divisions, and any agent, employee, representative <br /> 2 and all persons, corporations, or other entities acting by,through, under, or on behalf of Defendant <br /> 3 and all persons in concert with or participating with said Defendant with actual or constructive <br /> 4 knowledge of this injunction, only insofar as they are doing business in the State of California and <br /> 5 confined to Defendant's gasoline sales/mini market activities in the County of San Joaquin and <br /> 6 elsewhere in the State of California. <br /> 7 3. Defendant, in the course of Defendant's RETAIL GASOLINE STATION activities, are <br /> 8 pursuant to Health and Safety Code section 25280 et seq.,hereby permanently enjoined from: <br /> 9 a. Failing to submit Underground Storage Tank Permit Application-Form A and <br /> 10 Underground Storage Tank Permit Application-Form B, in violation of California Code of <br /> 11 Regulation, Title 22, section 2711(b); <br /> 12 b. Failing to maintain evidence of financial responsibility for taking corrective <br /> 13 action and from compensating third parties for bodily injury and property damage caused by a <br /> 14 release from an underground storage tank system, in violation of Health and Safety Code section <br /> 15 25292.2(a); <br /> 16 c. Failing to test secondary containment systems installed after January 1, 2001, <br /> 17 within six months of installation, in violation of Title 22 of the California Code of Regulations <br /> 18 section 2637(a); <br /> 19 d. Failing to retain a monitoring plan, in violation of California Code of Regulations <br /> 20 2712(i); <br /> 21 e. Failing to retain a written maintenance and monitoring record, in violation of <br /> 22 California Code of Regulations section 2712(b); <br /> 23 f. Failing to have a designated operator to perform monthly inspections, in violation <br /> 24 of California Code of Regulations sections 2715 (a) and 2715(c); <br /> 25 g. Failing to maintain a copy of the designated operator monthly inspections, in <br /> 26 violation of California Code of Regulations section 2715(e); <br /> 27 h. Failing to have facility employees trained by the designated operator by July 1, <br /> 28 2005, in violation of California Code of Regulations section 2715(f); <br /> -2— <br /> PERMANENT INJUNCTION AND FINAL JUDGEMENT PURSUANT TO STIPULATION <br />
