Failing to notify the local agency,when required to do so, including failing to <br /> 2 notify the local agency of any change in the designated operator no later than 30 days after the <br /> 3 change, in violation of Health and Safety Code section 25299(c) and California Code of Regulations <br /> 4 section 2715(a); <br /> 5 j. Failing to remove water from the secondary containment, including fuel/water <br /> 6 mixture not removed from spill buckets, in violation of Health and Safety Code section 25291(e). <br /> 7 4. Defendant, in the course of Defendant's RETAIL GASOLINE STATION activities, are <br /> 8 pursuant to Health and Safety Code section 25100 et seq., hereby permanently enjoined from: <br /> 9 a. Failing to post emergency coordinator information next to the telephone, in <br /> 10 violation of California Code of Regulations section 66262.34(d)(2). <br /> 11 5. Defendant, in the course of Defendant's RETAIL GASOLINE STATION activities, are <br /> 12 pursuant to Health and Safety Code section 25500 et seq.,hereby permanently enjoined from: <br /> 13 a. Violating Health and Safety Code section 25503.5(a), being a business that <br /> 14 handles a hazardous material or a mixture containing a hazardous material that has a quantity at any <br /> 15 one time during the reporting year equal to, or greater than, a total weight of 500 pounds, or a total <br /> 16 volume of 55 gallons, or 200 cubic feet at standard temperature and pressure for compressed gas, <br /> 17 including but not limited to DIESEL, GASOLINE,AND PRESOAK DETERGENT, failed to <br /> 18 establish and implement a business plan for emergency response to a release or threatened release of <br /> 19 a hazardous material for 717 W. 8TH STREET, STOCKTON, CALIFORNIA in violation of <br /> 20 Health and Safety Code section 25503.5(a); <br /> 21 b. Violating Health and Safety Code section 25504(b), business plan failed to <br /> 22 include emergency response plans and procedures in the event of a reportable release or threatened <br /> 23 release of a hazardous material, including but not limited to the following: <br /> 24 1. Immediate notification to the San Joaquin County Office of Emergency <br /> 25 Services and to the appropriate local emergency rescue personnel; <br /> 26 2. Procedures for the mitigation of a release or threatened release to <br /> 27 minimize any potential harm or damage to persons,property, or the environment; <br /> 28 3. Evacuation plans and procedures, including immediate notice, for the <br /> -3- <br /> PERMANENT INJUNCTION AND FINAL JUDGEMENT PURSUANT TO STIPULATION <br />
