SPRECKLES BLVD. <br /> MANTECA, CA 95336 <br /> t <br /> t <br /> TO WHOM IT MAY CONCERN, <br /> Our Department recently (July 20, 2016) received a complaint alleging that a service dog was <br /> inside of a shopping cart at the above referenced facility. <br /> According to California Retail Food Code, Section 113903: <br /> A"service animal" means any dog that is individually trained to do work or perform tasks for the <br /> benefit of an individual with a disability, including a physical, sensory, psychiatric, intellectual, or <br /> other mental disability. Tasks performed can include, among other things, pulling a wheelchair, <br /> f retrieving dropped items, alerting a person to a sound, reminding a person to take medication, <br /> or pressing an elevator button. <br /> Emotional support animals, comfort animals, and therapy dogs are not service animals under <br /> Title 11 and Title III of the Americans with Disabilities Act (ADA). Other species of animals, <br /> whether wild or domestic, trained or untrained,°are not considered service animals either. <br /> The manager or operator of a food facility may only ask two questions of the handier to <br /> determine if the dog is a service animal: <br /> 1. Is the animal required because of a disability? <br /> 2. What work or`task has the animal been trained to perform? <br /> A public accommodation facility is not permitted to ask for documentation, or proof, that the <br /> animal has been certified, trained, or licensed as a service animal. <br />
