The following is an itemized list of hazardous waste violations that have not been <br /> addressed for DEL RIO WEST PALLET as of January09, 2019. <br /> Open violations from April 27, 2016 inspection <br /> Violation #101 - Managed a hazardous waste without an identification number. <br /> This facility's hazardous waste ID number is inactive. A hazardous waste generator shall not treat, store, dispose <br /> of, transport or offer for transportation, hazardous waste without a hazardous waste ID number. Go to the DTSC <br /> web site http://www.dtsc.ca.gov/IDManifest/PERMHWID.cfm for the form to reactivate the ID number. <br /> Immediately reactivate your state ID number and submit evidence to the EHD. <br /> Violation #102 -Failed to determine if a waste is a hazardous waste or retain waste analysis on site for 3 <br /> years. <br /> According to Mr. Jaime Villalobos, oily wood chips used as absorbent are being disposed of in the trash. No <br /> hazardous waste determination has been made for the absorbent. Any person who generates a waste shall <br /> determine if the waste is a hazardous waste. Immediately stop disposal of oily absorbent to the trash, make a <br /> hazardous waste determination for this waste, and manage it according the Title 22 hazardous waste regulations. <br /> Submit a statement and supporting documentation explaining how this waste was managed. <br /> Violation #104 - No modified contingency plan. <br /> An emergency coordinator and modified contingency plan information is lacking. There must be at least one <br /> emergency coordinator on site or on call to coordinate emergency response measures, and the following <br /> information must be posted by a phone: the name and phone number of the emergency coordinator; location of fire <br /> extinguishers, spill control equipment, and if present, fire alarm; and the phone number of the fire department, <br /> unless the facility has a direct alarm. Immediately appoint an emergency coordinator and post the required <br /> information by a phone. A form is provided that can be used for this purpose. <br /> Violation #403 - Failed to keep hazardous waste containers closed except when adding or removing <br /> hazardous waste. <br /> A plastic drain container of used oil under a truck in the yard and several cut open containers of used oil in the shop <br /> were observed with no lids. All hazardous waste containers shall be closed at all times except when adding or <br /> removing waste. Immediately close these containers and ensure all hazardous waste containers are closed when <br /> not adding or removing waste. <br /> Violation #601 -Stored hazardous waste onsite greater than 180 days. <br /> Used oil was last hauled in July 2014. According to Mr. Villalobos, the used oil has not been disposed of since then <br /> because the tank is not yet full. Facilities who generate less than 1000 kg of hazardous waste per month and do not <br /> exceed 6000 kg of waste stored on site at any time may store waste on site up to 180 days. Immediately contact a <br /> licensed hazardous waste hauler to dispose of this waste under manifest and submit a copy of the manifest to the <br /> EHD. <br /> Violation #605 - Failed to completely label containers or tanks of hazardous waste. <br /> A plastic drain container of used oil under a truck in the yard and several cut open containers of used oil in the shop <br /> were observed with no labels. All hazardous waste containers shall be marked with the following information: <br /> -the words"Hazardous Waste' <br /> - name and address of generator <br /> - hazardous properties (ignitable, corrosive, reactive, toxic) <br /> - physical state (liquid, solid) <br /> -composition (contents) <br /> -accumulation start date <br /> Immediately label these containers and ensure that all hazardous waste containers are marked with all the required <br /> information. <br /> Page 1 of 2 <br />
