SUMMARY OF VIOLATIONS (CLASS I, CLASS II, or MINOR-Notice to Coml)ly) #1 and 2. Facility does not have a SPCC plan and failed to conduct periodic inspection. Pursuant to Health and Safety Code 25270.4.5(a) 25270.4.5. (a) Except as provided in subdivision (b), each owner or operator of a storage tank at a tank facility subject to this chapter shall prepare a spill prevention control and countermeasure plan prepared inaccordance with Part 112 (commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. Each owner or operator specified in this subdivision shall conduct periodic inspections of the storage tank to assure compliance with Section 112 (commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. In implementing the spill prevention control and countermeasure plan, each owner or operator specified in this subdivision shall fully comply with the latest version of the regulations contained in Part 112 (commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. Immediately, Prepare a SPCC pian for the facility. Submit the certification page to this office by 5123110 as proof of corrective action. Also submit a copy of the periodic inspection report to this office by 5123110 as proof of corrective action ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE($115).
