Facility failed to have a SPCC plan onsite and also failed to get the SPCC plan certified by a Professional Engineer (PE) Pursuant to Code of Federal Regulation (CFR) 112.3(d)(d) Except as provided in §112.6, a licensed Professional Engineer must review and certify a Plan for it to be effective to satisfy the requirements of this part. (1) By means of this certification the Professional Engineer attests: (i) That he is familiar with the requirements of this part ; (ii) That he or his agent has visited and examined the facility; (iii) That the Plan has been prepared in accordance with good engineering practice, including consideration of applicable industry standards,`and with the requirements of this part; (iv) That procedures for required inspections and testing have been established; and (v) That the Plan is adequate for the facility. - (vi) That, if applicable, for a produced water container subject to §112.9(c)(6), any procedure to minimize the amount of free-phase oil is designed to reduce the accumulation of free-phase oil and the procedures and frequency for required inspections, maintenance and testing have been established and are described in the Plan.(e) If you are the owner or operator of a facility for which a Plan is required under this section, you must: (1) Maintain a complete copy of the Plan at the facility if the facility is normally attended at least four hours per day, or at the nearest field office if the facility is not so attended, and (2) Have the Plan available to the Regional Administrator for on-site review during normal working hours. Immediately, prepare a SPCC plan and have the plan certified by a PE. Submit the certified page to EHD as proof of corrective action by 5123110. Also keep a current copy on site for record. #8 and 11. Facility stated the the location of the 2 - 10,000 gallon AST has been changed in the past 4 years. Facility also failed to have a'PE certify technical ammendments. Facility diad not amend the SPCC plan within 6 months pursuant to CFR 112.5(a) and pursuant to CFR 112.5(c)have a PE certify the change within 6 months of the change. Make sure that all applicble change is made in a timely manner and all technical amendments are certified by a PE. . #10. The facility has been in business for past 40 years and the AST have been at the facility prior to 2002. Faciltiy failed to review and evaluate the SPCC plan at least once every 5 years pursuant to CFR 112.5(b). Make sure a review and evaluation is performed on the SPCC at once every 5 years. #18. Facility failed to provide facilty diagram that shows the location and content of eachcontainer as required by CFR I I2.7(a)(3). Immediately, prepare a facilty diagram and keep a copy at the facility for record and review. ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL eE BILLED AT THE CURRENT HOURLY RATE($11$).
