Box 429 <br /> Fontana, CA 92335 <br /> Gentlemen: <br /> We have received your "Notice of Materials To Be Used," form HC-30, <br /> stating that you propose to use approximately 40,000 CY of imported borrow <br /> from a site in Tracy, CA at the Tennis Villa Subdivision located on the <br /> NW corner of Tracy Blvd. and Beech Nut Ave. <br /> A meeting took place March 18 , 1986 on this site in Tracy that <br /> included Mr. Jim Pryor of Brutoco, Mr. Jackson Chih of Renown Enterprises <br /> and myself. Renown Enterprises is the developer of this site in Tracy. <br /> At that meeting, Mr. Chih told me that he planned on using all of his <br /> non-contaminated soil at his site in Tracy and that it was only the soil <br /> contaminated with crude oil that he was proposing to provide to Brutoco. <br /> The presence of crude oil contaminates was obvious by visual inspection. <br /> It is the position of Caltrans that we will not allow contaminated <br /> material to be placed as imported borrow, nor will we accept any material <br /> that increases our future liability. We are not rejecting the soil from <br /> this Tracy site , but only the contaminates. If you can remove the contam- <br /> inates prior to delivery to the project, then the material would be <br /> allowable. If you can get Renown Enterprises to provide you with non- <br /> contaminated material from this Tracy site, then that would be allowable. <br /> We will not accept any material when special handling is required by the <br /> Central Valley Regional Water Quality Control Board (CVRWQCB) , the San Joaquin <br /> Local Health District (SJLHD) , or other similar agency.
