Scott Mansholt _ 5 - 21 November 2007 <br /> TAOC Tracy Pump Station <br /> A copy of the deed restriction filed for the property including San Joaquin County <br /> recording documentation needs to be provided. <br /> SUMMARY <br /> 1 . According to site characterization reports in conjunction with the results of the human <br /> health assessments and review by OEHHA, Regional Board staff concur that the <br /> petroleum-affected soil has been delineated and is limited in extent. In addition, the <br /> extent of impacted groundwater is limited, has been delineated, and concentrations are <br /> attenuating. Review of the data indicates that residual petroleum hydrocarbons in soil <br /> at the site do not result in a significant source of TPH constituents to groundwater. <br /> 2. A review of a September 2007 ecological database summary of state and federal <br /> agency documents did not report ecological risks at or within one-half mile of the site. <br /> 3. Chevron has indicated that the future use of the site will be for commercial/industrial <br /> purposes and that no structures/buildings are planned for the property; a deed <br /> restriction will be recorded so that site reuse restrictions are documented. <br /> 4. OEHHA's findings concluded that that no significant risk/hazard is expected to occur <br /> due to the PAH soil contamination down to 10 feet below grade. <br /> 5. Based on the field investigative data and information coupled with OEHHA's findings, <br /> and with the provisions that the information provided was accurate and representative <br /> of site conditions, no further action is required and the monitoring wells can be properly <br /> destroyed. <br /> 6. In accordance with the No Further Action Request, upon verification of proper <br /> monitoring well destruction, the SMP and a copy of the deed restriction documentation <br /> is submitted, the Regional Board will issue a No Further Action letter for the site. <br /> If existing, additional, or previously unidentified chemical constituents at the site cause or <br /> threaten to cause pollution or nuisance or are found to pose a threat to public health or water <br /> quality, then: 1) nothing in this determination is intended or shall be construed to limit or <br /> preclude the Regional Water Board or any other agency from taking any further enforcement <br /> action, and 2) this letter does not relieve Chevron of any responsibilities mandated under the <br /> California Health and Safety Code and/or the California Water Code. <br />
