California law requires a <br /> person to inform the state if a situation is encountered that can be considered an immediate <br /> endangerment to the public's health or welfare and/or to the environment. Therefore, the client <br /> shall be contractually bound to make said disclosures in lieu of Kleinfelder, its owners, principals, <br /> employees, or subcontractors. <br /> CLIENT RESPONSIBILITIES AND ASSUMPTIONS <br /> This work plan is based on the following assumptions: <br /> • This work plan is based on the presumption that OLWD personnel will clearly mark <br /> utilities and will provide any and all available survey maps or other data to <br /> determine the location of underground storage tanks, existing subsurface <br /> structures, underground utilities and services. <br /> • The client will provide Kleinfelder with written authorization for the proposed work. <br /> • Adequate workspace and access will be provided by the client. <br /> • Kleinfelder is not responsible for the site safety of others. <br /> • Soil and/or water generated during the field assessment will be the responsibility of <br /> the client. Soil and water generated will not be contained and will be left on site <br /> near the probe locations. <br /> • The client should be aware that penetrating the site's surface is inherently risky. It <br /> is impossible to determine with certainty the precise location of all structures (such <br /> as irrigation lines, septic system tanks or leach fields) which may be buried in the <br /> ground. <br /> LIMITATIONS <br /> Kleinfelder prepared this work plan in accordance with generally accepted standards of care which <br /> exist in San Joaquin County, California, at this time. It should be recognized that definition and <br /> evaluation of geologic and environmental conditions are a difficult and inexact science. <br /> Judgments leading to conclusions and recommendations are generally made with incomplete <br /> knowledge of the subsurface conditions present.
