PHS/EHD has prepared <br /> the following comments for your action and consideration. <br /> On February 28, 1997, PHS/EHD indicated to the State Water Resources Control Board Cleanup <br /> Fund staff that Chevron was not in compliance at the time of their review and that Chevron <br /> would be granted 90 days in order to achieve compliance. You should note that without your <br /> recent efforts to initiate remediation at the site, your site would have been deemed not in <br /> compliance without the possibility of having 90 days in order to achieve compliance. <br /> Compliance Summary <br /> On October 24, 1996, PHS/EHD, the Central Valley Regional Water Quality Control Board <br /> representative and the Deputy District Attorney of San Joaquin County held an administrative <br /> hearing at which yourself and John Randall of Chevron attended. It was agreed that Chevron <br /> would evaluate options and provide either a committed effort in writing or a petition to the State <br /> Water Resources Control Board by October 28, 1996. <br /> On October 31, 1996, PHS/EHD received Chevron correspondence dated October 28, 1996 <br /> which indicated that Chevron would proceed to meet water quality goals put forth in the <br /> "Workplan for Soil and Groundwater Remediation" dated August 31, 1995 which PHS/EHD had <br /> already disapproved in PHS/EHD correspondence dated November 30, 1995. Chevron also <br /> committed, to fulfill Chevron's obligations to remain in compliance with applicable laws and <br /> regulations, to performing drilling of all remediation wells during the week of November 11 , <br /> 1996, to install subsurface remediation piping and abatement equipment during the week of <br /> November 18, 1996, to start-up the remediation system prior to November 29, 1996 and to <br /> submit a system performance summary and corrective action plan (CAP) by May 30, 1997. <br /> On November 13, 1996, the drilling of the vapor extraction wells and air sparge wells was <br /> initiated. Due to site upgrade construction activities and the additional soil contamination <br /> evidenced, the installation of the wells was not completed until January 24, 1997. <br /> On December 5, 1996, PHS/EHD issued correspondence indicating that the CAP which was due <br /> by May 30, 1997 must include groundwater cleanup goals consistent with the Central Valley <br /> Regional Water Quality Control Board's Basin Plan pursuant to the Underground Storage Tank <br /> A Division of San Joaquin County Health Care Services <br />
