1 into the Tanks, and that the output openings were paved over at some time prior to November of 1965. <br /> 2 3. 1 have never used the Tanks, and no one else has used the Tanks at any time or for any <br /> 3 purpose during the time period in I have been the owner of the Property, beginning in Febru. ry of <br /> 4 1976. Furthermore, I have not observed, or been directly or indirectly informed of any use being made <br /> 5 of the Tanks at any time, including specifically since the time I first visited the Property in November <br /> 6 of 1965. <br /> 7 4. 1 had at some point been told that a gas station had been operated on the Property at <br /> 8 some time between the 1950's and 1960's, but I have no personal knowledge that this was in fact true. <br /> 9 5. I first saw the Property some time in the month of November of 1965. At that time <br /> 10 there was no gas station on the property, no advertising signs for such, and no pump islands. In <br /> 11 addition, the output openings from the Tanks had already been paved over, and only two plates which <br /> 12 appeared to be manhole covers were visable. If the Tanks had in fact ever been used in the past, they <br /> 13 were no longer usable as of November of 1965. The tanks were paved over some time prior to <br /> 14 November of 1965, except for two metal-plate-covered input openings. The output pumps and <br /> 15 associated piping had been disconnected prior to that time as well (if such ever was in fact connected <br /> 16 in the first place). It is clear in hind sight that these Tanks had been rendered inoperable and <br /> 17 abandoned at some unknown time prior to November of 1965. <br /> 18 6. My former husband, Harry Sandberg, has been a tenant on the Property since <br /> 19 approximately May of 1966 up to the present time, and since the Tanks are located under what is now <br /> 20 the parking lot for the Property, he would have observed if any use were made of the Tanks. <br /> 21 7. On or about June 18, 1991, I was provided with a copy of the PHS/EHD policy <br /> 22 applicable to tanks abandoned prior to July 1, 1984, and was informed that this policy was applicable <br /> 23 to me and that I needed to comply with it. The policy specifically states that tanks like mine which <br /> 24 were abandoned prior to July 1, 1984, were not required to comply with the statutory closure standards <br /> 25 and requirements, yet the PHS/EHD has consistently demanded'that I "properly close" the Tanks, <br /> 26 which I understand to mean that they are attempting to require me to comply with a statute that they <br /> 27 have told me does not apply to me. A true and correct copy of the PHS/EHD Policy and the letter <br /> 28 which accompanied it is attached hereto as Exhibit "A". <br /> _ 2 - 0002h3 <br /> i <br /> . i <br />
