Boyle and provides the following response to her comments. <br /> On May 1, 1998, PHSIEHD staff witnessed the sampling of soil which was <br /> beneath two underground storage tanks (UST's) that were removed from the <br /> above referenced site on that date. The soil type beneath the tanks was <br /> reported to be sand. The soil samples were obtained from about 11 to 13.5 feet <br /> below surface grade (bsg). Total petroleum hydrocarbons as diesel were <br /> detected in the soil sample from beneath tank #1 at 1300 mg/kg and 1100 mg/kg <br /> in the soil sample beneath tank #2. These soil sample results confirm that there <br /> was an unauthorized release from the UST's. <br /> San Joaquin County Flood Control maps indicate that in 1986 when depth to <br /> groundwater was high that the depth to water in this area was about 110 feet <br /> bsg. Since the soil is sandy and the vertical extent of the contamination has not <br /> been defined, there is evidence that groundwater has been or may be affected <br /> by the unauthorized release from the UST's. PHSIEHD is requesting an <br /> investigation of the lateral and vertical extent of contamination based on the <br /> actual or potential effects of contaminated soil or groundwater on the <br /> groundwater resources. <br /> As to the identification of responsible parties, your attorney provided a copy of a <br /> lease agreement between John and Louise DeMartini and the Signal Oil <br /> Company which was purchased by Chevron. This document does not prove that <br /> Signal Oil Company was the last owner or operator of the UST's before their use <br /> was discontinued_ Until evidence is provided that Signal Oil (Chevron) was the <br /> last owner or operator of the UST's before their use was discontinued, you will <br /> remain the only responsible party named by PHSIEHD.
