determine if the quarterly monitoring and sampling frequency
requirements for this well should be modified.
PHS-EHD recommends that you continue to contact the State Water
Resources Control Board-Cleanup Fund Unit (Fund) and attempt to
ascertain your site' s status . If there have been changes in your
corporate status, you may qualify for a change in priority.
Although involvement with the Fund is voluntary on your part,
site investigation and remediation of contaminated soil and/or
groundwater is not a voluntary option for you. As the
responsible party for your removed leaking underground tank, you
are required to investigate and mitigate the contamination
documented on your site.
In the meeting you mentioned that your business is currently
dealing with financial problems and you cannot fund investigative
or corrective actions that you may be required to do . There are
some low cost or low interest loan programs available through
both California State agencies and the Federal Government . In
your conversations with the State Water Board you should mention
this to them and ask for details on how you may benefit from
them.
The State Water Board may require a current financial statement
from you to verify your current financial status . A copy of this
letter will be forwarded to the State Water Resources Control
Board so they may be apprised of our meeting.
Once again, I hope this letter answers your questions and should
you have any further concerns, feel free to contact me at
(209) 468-3454 . I require 48 working hours notice for all
appointments to witness field activities, such as well. sampling.
The best time of day to call is Sam to gam, Monday through
Friday.
Donna Heran, REHS, Director
Environmental Health Division IW/
Michael Infurn Senior REHS Diane M.
