One drum has tipped <br /> over and is potentially leaking an unknown substance. Address is west of 2525 S. Mariposa Rd. <br /> OBSERVATIONS: <br /> Observed three white poly drums, each had a 50 gallon capacity and all were upright. Two of the drums were damaged. <br /> One drum had a crack across the top and appeared to have 10 gallons of material in it. Another drum had a whole on the <br /> top of it, and appeared to be full of a dark liquid. The third drum was fully intact and appeared to be full of a dark liquid. <br /> Between three to four feet west of the drums a dark liquid was observed, similar in color and consistency to the liquid that <br /> was observed in the two full drums. <br /> VIOLATIONS: <br /> • Discharge of any waste, including sewage <br /> (CA Health and Safety Code 5411) <br /> Discharge of waste or sewage to water or within 150 ft. of waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> • Improper disposal of a hazardous waste <br /> (CA Health and Safety Code 25189.5) <br /> ° Permitting or Maintaining a Nuisance <br /> (SJC Ordinance Code Section 8-5100) <br /> Other Violation <br /> CORRECTIVE ACTIONS/ORDER: <br /> • Investigate and abate contamination under the oversite of the appropriate lead agency. <br /> • Submit copies of hazardous waste manifests/disposal records to the EHD. <br /> Within 30 days. <br /> ° Other Correction 9171 9690 0935 0152 1709 00 <br /> COST RECOVERY: All EHD time associated with this Spill Response is billed to the responsible party at the current hourly <br /> rate.
