SANJ O A Q U I N Environmental Health Department <br /> —COUNTY— <br /> Complaint Record Daily Time and Activity Summary from 7/3/2017 to <br /> 9/28/2017 for C00043740 located at <br /> 12380 VAN ALLEN ROAD <br /> Activity Date Recorded by <br /> 08/09/2017 Received the following email on 8/1/17 from Damon Gordon of Wilbur Ellis Co.: PE 2546 FLORIDO <br /> 18 min "Good afternoon Elianna, SC 544 <br /> We have received the test results for the spill on Van Allen Rd. in Escalon, CA. <br /> Per the lab there are no high levels that trigger any further testing for the metals. I <br /> have attached the test results along with the SDS for the absorbent material that <br /> was used and recovered from the soil. We would like to send it in for further <br /> testing measuring the nitrogen level to have it applied for its intended purpose as <br /> fertilizer. The absorbent material consists of 100% diatomaceous earth and <br /> natural substance. Can you please let me know if there are any other tests you <br /> would like so that we can dispose of the soil properly?" <br /> I replied to Damon on 8/2/17 indicating that I forwarded his email to my <br /> supervisors, Garrett B. and Muniappa N., in order to obtain an appropriate <br /> response to his email. <br /> I printed lab results and the SDS for the absorbent and attached these documents <br /> to the complaint documentation. <br /> 08/09/2017 Spoke to Muniappa Naidu regarding Damon's email requesting to use the fertilizer PE 2546 FLORIDO <br /> 12 min for its intended purpose. Muni indicated that Damon would have to submit a letter SC 544 <br /> from the farmer indicating an agreement to use the fertilizer, as well as a <br /> statement indicating what the fertilizer will be used for. I emailed Damon this <br /> information. <br /> 08/16/2017 Called Damon Gordon to request an update on the disposal of the spilled material. PE 2546 FLORIDO <br /> 18 min He stated he is waiting for Patriot Environmental to schedule a day to pick up the SC 544 <br /> bins of contaminated soil and transfer them to the farmer's farm who will utilizing <br /> the soil for its intended purpose. Gordon stated he would send the EHD the signed <br /> agreement letter by the farmer on the day that the soil is taken to the farm. I <br /> requested Damon to email me an unsigned copy of the letter for Muni's review. <br /> Muni reviewed the letter and indicated that we need a statement stating that the <br /> farmer is aware that the soil is recovered from the spill and that he still agrees to <br /> use the soil for its intended purpose. I called Damon back and notified him of the <br /> statement that we need to be able to close out the complaint. Damon agreed that <br /> he would include the statement in the letter, have the farmer sign it, and send the <br /> letter to the EHD. <br /> 09/28/2017 Reviewed an agreement letter signed by Damon Gordon of Wilbur Ellis and John PE 2546 FLORIDO <br /> 30 min Arnuado (the "Customer"), received via email on 9/6/17 from Damon Gordon. The SC 544 <br /> agreement letter states: "Customer fully understands that the Material that <br /> Customer will have spread on Customer's ranch is reclaimed soil from a spill that <br /> contained UAN-32. Customer acknowledges and agrees that Customer is using <br /> the Material for its intended purpose to fertilize." <br /> Printed and gathered all complaint documentation and submitted next to Garret <br /> Backus'desk for review by a lead senior inspector. <br /> Page 3 of 3 <br />
