WASTE DISCHARGE REQUIREMENTS ORDER NO. R5-2003-0044 -6- <br /> GENERAL ORDER FOR LAND DISPOSAL <br /> OF GROUNDWATER OR SURFACE WATER <br /> FROM CLEANUP OF PETROLEUM FUEL POLLUTION <br /> substances clean up actions. This exemption applies to minor clean up actions where <br /> treated groundwater and surface water will be disposed of to land. Application of this <br /> exemption is further limited by the factors described in Title 14 CCR Section 15300.2, <br /> subsections (b), (c), (d), (e), and (f). Additional compliance with CEQA may be required <br /> for individual projects. <br /> 25. The Regional Board has notified the interested agencies and persons of its intent to adopt <br /> general waste discharge requirements for the discharge of groundwater from the <br /> investigation and cleanup of petroleum fuel pollution and has provided them with an <br /> opportunity to submit their written comments and recommendations. <br /> 26. The Regional Board, in a public meeting, heard and considered all comments pertaining to <br /> this permit. <br /> IT IS HEREBY ORDERED, General Order No. 91-25000 is rescinded and that Dischargers, in <br /> order to meet the provisions contained in Division 7 of the California Water Code, and regulations <br /> -- and guidelines adopted thereunder, shall comply with the following: <br /> A. APPLICABILITY <br /> 1. The source of all discharges covered by this Order shall be limited to groundwater or <br /> surface water from the investigation and cleanup of petroleum (Findings No. 1 — 6 <br /> above). <br /> 2. Dischargers seeking coverage under this Order shall submit a complete Notice of Intent, <br /> including a Report of Waste Discharge (as detailed in Attachment A) along with an <br /> appropriate filing fee. <br /> 3. If the Executive Officer finds that the proposed discharge qualifies for coverage under <br /> this Order, the Discharger shall be issued a Notification of Applicability. If a proposed <br /> discharge does not qualify for this Order, or if significant public comments are received <br /> on the application, the proposed discharge may be considered for individual waste <br /> discharge requirements or for coverage under this Order at a meeting of the Regional <br /> Board. <br /> B. DISCHARGE PROHIBITIONS <br /> 1. Discharge of material other than surface water or groundwater from the investigation <br /> and cleanup of petroleum fuel pollution, or discharge from the investigation of <br /> petroleum fuel pollution where the surface or ground water contains waste constituents <br /> not addressed by this Order, is prohibited. <br /> 2. The discharge of wastes,wastewater,or treated wastewater into any surface water or <br /> surface water drainage course is prohibited. <br />
