• <br /> representatives, contractors and/or subcontractors; and (B)any breach by Chevron <br /> or its agents, employees, representatives, contractors and/or subcontractors of the <br /> provisions of this Agreement. <br /> S. In lieu of insurance coverage, Chevron maintains a self-administered informat <br /> claims program with respect to its duties hereunder. Chevron shall not permit any <br /> consultant, architect, engineer or contractor("Chevron Agent")to enter onto the <br /> Property or commence work on or relating to the Property until such parties have <br /> complied with the following insurance requirements: <br /> (a) Prior to entry onto the Property, all Chevron Agents shall deliver to Owner <br /> evidence reasonably satisfactory to Owner that such Chevron Agent carries, in <br /> full force and effect, the fallowing insurance: (i) Workers Compensation <br /> Insurance(at a minimum limit of$1,000,000) for all persons whom it employs in <br /> carrying out its activities on the Property; and(ii) Commercial General Liability <br /> Insurance on an"occurrence"basis, with deductibles reasonably acceptable to <br /> Owner,with a cornbined single lirnit for bodily injury and property damage of not <br /> less than Two Million and Nell 00 Dollars($2,000,000); and (iii)automobile <br /> liability insurance,including coverage for all owned,hired and non-owned <br /> automobiles, with not less than Two Million and No/100 .Dollars($2,000,000), <br /> combined single limit each occurrence For bodily injury and property darnage. <br /> (b) Those entities and persons named below shall be included as an additional <br /> insured under the coverage specified above with the following provisions <br /> included within each applicable policy or an endorsement to the policy, a certified <br /> copy of'which shall be delivered to Owner prior to entry onto the Property: <br /> Coverage afforded by this Policy shall also apply to Owner, <br /> and each of its and their members,managers and affiliates and <br /> all of their respective officers, directors, shareholders, and <br /> employees and all of their respec�ive successors and assigns, as <br /> additional insureds,but only with respect to legal liability or <br /> claims caused by, arising out of or resulting from the acts or <br /> omissions of the named insured or others performing acts on <br /> behalf of the named insured. <br /> (c) Each insurance policy shall: (i) except as otherwise approved in writing by <br /> Owner, be issued by insurance carriers licensed and approved to do business in <br /> California,having a general policyholders rating of not less than an "A" and <br /> financial rating of not less than "VIII" in the most current Best's Insurance <br /> Report;(ii)contain a provision that the policy shall not be subject to material <br /> alteration to the detriment of Owner or Chevron Agent or cancellation without at <br /> least thirty(30) days' prior written notice being given to Owner by registered <br /> mail; (iii)provide that such policy or policies and the coverage evidenced thereby <br /> are primary and any insurance maintained by the additional insureds is <br /> Site Access Agreement <br /> Page 3 of 8 <br />
