noncontributing with such primary coverage; and (iv) contain severability of
<br /> interest and cross liability clauses.
<br /> (d) Chevron shall cause all Chevron Agents to waive all rights against Owner
<br /> and the other additional insureds for damages caused by fire and other perils and
<br /> any other risk to the extent covered by Chevron Agents' policies of insurance or
<br /> required to be covered by Chevron Agents' policies of insurance as set forth
<br /> above.
<br /> (e) Nothing contained in these insurance requirements is to be construed as
<br /> limiting the type,duality or quantity of insurance Chevron Agents should
<br /> maintain or the extent of Chevron Agents' responsibility for payment of damages
<br /> resulting from its operations.
<br /> 6. Chevron shall be solely responsible for and assumes all liability and risk for the
<br /> safety and protection (against damage, destruction, theft or vandalism.) of any
<br /> equipment, vehicles,building materials and/or other personal property used,
<br /> stored,parked or left on.the Property by Chevron or its agents, employees,
<br /> representatives, or consultants.
<br /> 7. Chevron, and anyone claiming by, through, or under Chevron,hereby waives its
<br /> right to recover from and fully and irrevocably releases Owner, its affiliate
<br /> organizations and entities, and each of its and their partners, members, managers,
<br /> officers, directors, shareholders, agents, representatives, employees and all of
<br /> their respective successors and assigns(collectively, the"Released Parties,,'and
<br /> each.a"Released Party") from any and all claims that Chevron may now have or
<br /> hereafter acquire against any of the Released Parties for any claims, costs, loss,
<br /> liability,damage, expenses,demand, action or cause of action,other than claims
<br /> relating to or arising out of the Released Party's sole negligence, and arising from
<br /> or related to Chevron's entry onto the Property, activities on the Property, and
<br /> conditions on or affecting the Property, including,without limitation, any
<br /> construction defects,property defects, or ether conditions, latent or otherwise,
<br /> including environmental conditions and matters. This release includes claims of
<br /> which Chevron is presently unaware or which Chevron does not presently suspect
<br /> to exist which, if known by Chevron, would materially affect Chevron's release to
<br /> Owner_ Chevron specifically waives the provision of California Civil Code
<br /> section 1542,which provides as follows:
<br /> A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE
<br /> CREDITOR.DOES NOT KNOW OR EXPECT TO EXIST IN HIS FAVOR AT
<br /> THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN TO HIM
<br /> MUST HAVE MATERIALLY AFFECTED THE SETTLEMENT WITH THE
<br /> DEBTOR.
<br /> In this connection, and to the extent permitted by law, Chevron hereby agrees,
<br /> represents, and warrants that Chevron realizes and acknowledges that factual
