Petitioner has designated certain real property locate <br /> 2 within its jurisdictional boundaries to be used for the <br /> 3 construction of affordable housing and related facilities and <br /> 4 infrastructure; that area is commonly referred to as the Gleason <br /> 5 Park Redevelopment Project ("Project") . Real property designate <br /> 6 by the Agency must be acquired for the Project by purchase, or by <br /> 7 utilizing the power of eminent domain. <br /> 8 3 . Petitioner seeks to enter on properties located in the <br /> 9 Project area to make preliminary studies prior to the initiatio <br /> 10 of acquisition of said properties . <br /> 11 4 . The properties subject to this Petition for entry are <br /> 12 two of the properties designated in the Project area for <br /> 13 acquisition. The properties are owned by BOB FRANCO an <br /> 14 described as follows ("Property") ; <br /> 15 a. 323 South American Street, Stockton, California, <br /> 18 APN 149-095-06; and <br /> b. 328 South California Street, Stockton, California <br /> 17 APN 149-095-15; and <br /> 18 c. 310 South California Street, Stockton, California <br /> APN 149-095-16 <br /> 19 <br /> 20 5 . As a condition for acquiring the properties needed for <br /> 21 the Project, the Agency must determine whether there exists an <br /> 22 hazardous substances as defined under Federal and State law on <br /> 23 the property. Such determination is made by initiating a "Phase <br /> 24 I Environmental Site Assessment" ( "Phase I") of the Property. <br /> 25 That process will include the observation of the Property for <br /> 26 evidence of activities involving the use, storage, or disposal of <br /> 27 hazardous material . <br /> 28 <br /> 2 <br />
