For the purpose of conducting the above-described <br /> 4 activities, the Petitioner, and its agent, shall have entry onto <br /> 5 the Property, without interference, to the following areas : (1) <br /> 6 the exterior of the structure (s) , (2) the interior of the <br /> 7 structure (s) , (3) parking facilities and other open areas, an <br /> 6 (4) any other area or structure that is observed by Petitioner at <br /> 9 the time of the inspections and would be necessary for completing <br /> 10 the environmental determinations for the Property. <br /> 11 S . The entry and activities described above shall not <br /> 12 result in actual damage and/or substantial interference wit' <br /> 13 possession and use of the Property. If soil sampling occurs, <br /> 14 boring locations will be restored to the original condition. An <br /> 15 penetration through concrete or asphalt will be reconditioned. <br /> 16 6. Petitioner, and its agent, shall not discuss the <br /> 17 purpose of the inspection with any person who is identified as a <br /> 16 tenant of Respondent , Petitioner, and its agent, shall refer an <br /> 19 designated tenant or tenants who make inquiries as to the purpose <br /> 20 of the activities of Petitioner, and its agent, to owner . <br /> 21 7 . Respondent shall provide access to each of the areas <br /> 22 described above 1,0 - 1 — , 2000, at <br /> 23 a.m. /en-m , until such time as the Phase I is completed. <br /> 24 8 . Should Petitioner determine that a Phase II is <br /> 25 required, Petitioner shall notify owner of the need for such <br /> 26 Phase II . Petitioner and owner shall agree to a time and date <br /> 27 convenient to conduct the Phase II . The time for entry for said <br /> 28 Phase II shall not be later than 10 calendar days from the date <br /> 5 <br />
