Said access may include more than one entry and ma <br /> 2 occur at a subsequent time or times based on the need to evaluate <br /> 3 the findings developed by the Phase I . <br /> 4 NOW, THEREFORE, IT I9 HEREBY ADJUDGED, ORDERED, AND DECREE <br /> 5 that : <br /> 6 1 . Petitioner, and its agent, are hereby authorized an <br /> 7 empowered to enter onto the Property to conduct Phase I and Phase <br /> 8 II Environmental Assessments, and shall be permitted to engage in <br /> 9 all activities described herein to conduct said assessments, an <br /> 10 any other activities that are reasonably necessary to accomplis <br /> 11 that purpose . <br /> 12 2 . The activities authorized by this Order include, but <br /> 13 are not limited to, the observation and inspection of the <br /> 14 Property for evidence of activities involving the use, storage,) <br /> 15 or disposal of hazardous materials . The activities shall include <br /> 16 an interview of the tenant manager and/or owner, an inspection o <br /> 17 reported sensitive features, and an inspection of the complete <br /> 18 structure and grounds . Sensitive features include, but are not <br /> 19 limited to, underground storage tanks, aboveground storage tanks, <br /> 20 vent lines, patch work in the asphalt, dry wells, sumps, drains, <br /> 21 or areas of disposal evidencing such activity. <br /> 22 3 . In the event that the Phase I suggests to the <br /> 23 Petitioner the presence of hazardous materials, Petitioner shall <br /> 24 be permitted to conduct a Phase II on the Property. The <br /> 25 determination of whether a Phase II is required rests solely i <br /> 26 the discretion of Petitioner.
