Verhagen, Esq.
The Marley Company
1900 Shawnee Mission Parkway
Mission Woods, Kansas 66205-2001
Dear Mr. Verhagen:
REQUEST FOR EXTENSION
The Department of Health Services (Department) , Toxic Substances
Control Division (TSCD) , has reviewed your December 22 , 1988,
request for an extension of the Remedial Investigation Report
(RIR) submittal deadline.
The Department cannot grant your proposed 10 1/2 month Remedial
Action order (RAO) extension for submittal of the RIR. The
length of this extension would create excessive delays in the
remediation of the site. Our concern is further heightened as a
result of the low operational frequency of the extraction and
treatment program currently underway.
As an alternative, the Department will make the following
revisions to the RAO schedule:
1. Submit a report on all Phase IV work done to date.
Submittal of this report to the Department must be by close
of business on March 1, 1989 .
2 . Submit a detailed Phase V Workplan by March 1, 1989 . This
Workplan must include the continuous coring of boring 111OX"
and installation of the deep aquifer well (between the High
School and the South Yard) as specified in the Department's
April 29, 1988, approval letter.
3 . Submit the Feasibility Study (FS) as originally scheduled in
the RAO by July 1, 1989 . The final RIR can be combined with
the FS at this time. Merging these documents will then
allow the Marley Cooling Tower Company (MCTC) to be on
schedule with the RAO. The FS should be started midway
