CAD009140120 <br /> Dear Mr. Wylly: <br /> On February 18 , 1993 , the Surveillance and Enforcement <br /> Branch of Region 1, Department of Toxic Substances Control <br /> (Department) , completed a financial responsibility review for The <br /> Marley Cooling Tower Company (Marley) located at 150 North <br /> Sinclair Avenue, Stockton, California 952Q7 . As a result of this <br /> review, the following violations were determined: <br /> Schedule of Violations <br /> 1. Title 22 , California Code of Regulations (Cal Code of <br /> Regs. ) , Section 66265. 145 (e) (3) (A) : <br /> On or about February 18, 1993 , Marley did not use the <br /> required wording on the financial test documents. <br /> 2 . Title 22 , Cal Code of Regs. , Section 66265. 144 (b) <br /> On or about February 18, 1993 , Marley did not adjust their <br /> post-closure cost estimate since their July 28, 1989, <br /> financial test submittal to the Department. <br /> In 1989 Marley demonstrated $387, 000 for post-closure. The <br /> 1989 figure must be inflated by 1990 and 1991 Gross Domestic <br /> Product inflation factors, 1. 041 and 1. 036 respectively. <br /> s <br />
