RELEASE <br /> This Release is made as of 'the 1st day of 'July, 1990, by <br /> FRANK WOODARD ("Woodard") and: WILLIAM WHITMAN ("Whitman") in favor <br /> of\KILPATRICK'S BAKERIES, INC. ("Kilpatrick's") : <br /> WHEREAS, in 1988 Kilpatrick' s sold to Woodard the <br /> property commonly known as 1717 S. Center Street, Stockton, <br /> California: (and legally described on Exhibit "A" hereto) (herein <br /> the "Property") ; and <br /> WHEREAS, although Woodard acquired title to the Property <br /> in his own name,' he was in such acquisition acting as the agent <br /> for Whitman, who now is the owner of record of the 'Property; and <br /> WHEREAS, the Property contains an under round storage <br /> tank ("UST•') ; and <br /> WHEREAS, subsequent to their acquisition of the Property <br /> 4 Woodard and Whitman have received notifications from the <br /> government demanding payment of permit fees associated° with the <br /> UST and also demanding assurance that the UST is in compliance <br /> with pertinent UST laws and regulations; and <br /> -1- <br />
