BIRKIE • PAGE 03
Scott Lehecka, Esq.
Hanna&Morton LLP
March 28,2000
Pie 2
required periodically to pay for a sewer bill on the property. This is what I now know
with respect to that matter.
Apparently ARCO obtained a demolition permit to take down the station
sometime in 1998. A condition on that permit was that ARCO should have dug out and
capped the sewer line. Upon completion,ARCO should have requested an inspector at
city hall to re-inspect the property. Apparently, this reinspection never occurred. ARCO
needs to resolve this matter-- whether it is a`paper' oversight or actual work that needs
to occur. To facilitate ARCO's ease in following up on this matter, the city employee
with whom Ms. Halvorson spoke was Inspector Blake Froberg at (209) 937-8561. 1
recommend that you or another ARCO representative follow up with Mr. Froberg. Please
let me know that the reinspection for the demolition permit has occurred and that the
sewer has been properly capped so that the Halvorsons can terminate that sewer bill.
I look forward to receiving final documents for signature at your earliest
convenience. Please include a paragraph that allows for counterpart signatures. In that
way,we will both have original copies of the access agreement in our files. As before,
thank you for your diligence in this matter. If you have any further questions,do not
hesitate to call.
Very truly yours,
BROOKE K.
