Charter Way Stockton, CA 95206 <br /> Dear Scott: <br /> This letter follows up my letters to you dated March 7, and March 13, 2000 <br /> concerning our conversation of March 3,2000. I had provided comments to ARCO's <br /> latest version of the access agreement. I thought that we were agreed as to all of the terms <br /> with the exception of how restoration of the property will be defined. I had requested <br /> language similar to that set forth in the original lease. You had wanted to check with Mr. <br /> Kyle Christie to assure that the property was fenced before committing to that language. <br /> My client responded to my courtesy copy of the March 7, 2000, letter and informs me that <br /> the property is fenced. In fact, ARCO changed the lock on the fence a number of months <br /> ago and apparently has the only key. My client does not have a key to the new lock. As <br /> ARCO has the property fenced and is in control of the property, I would appreciate a <br /> response from you as soon possible so that we finalize the agreement.
