If water could enter into the secondary containment by precipitation or
infiltration, it must be removed and disposed of properly. Immediately remove this liquid, make a hazardous waste
determination per Title 22 hazardous waste regulations, and manage it accordingly. Ensure that the diesel fill sump
is maintained free of liquid.
This is a repeat violation, Class II.
318 CCR 2636(f)(2) Leak detector failed to detect a 3.0 gallons per hour leak at 10 pounds per square inch.
The 87 line leak detector failed to detect a leak when tested. All line leak detectors shall be capable of detecting a
3-gallon per hour leak at 10 psi. Immediately have a properly licensed, trained, and certified contractor repair or
replace the failed leak detector (LG 113-x listed, if applicable) and obtain a permit within one business day from the
EHD. If the failed leak detector can't be replaced immediately, there is a possibility that the 87 UST system may be
red tagged to prevent fuel inputs.
This is a repeat violation, Class II.
319 CCR 2635, 2637.1, 2665, 2712 No spill bucket, failed to contain 5 gallons, no means to keep it empty, or failed to be
tested.
The diesel spill container failed when tested. All spill containers shall have a minimum capacity of five gallons and
be capable of containing a spill or overfill until it is detected or cleaned up. Immediately discontinue deposition of
petroleum into this tank until the component is repaired or replaced by a properly licensed, trained, and certified
contractor under permit and inspection of the EHD. If the spill container can't be replaced immediately, there is a
possibility that the diesel UST system may be red tagged to prevent fuel inputs.
This is a repeat violation, Class II.
Overall Inspection Comments:
Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement
documenting the corrective actions that have been or will be taken for each violation, and any supporting
paperwork, by April 7, 2019.
NOTE: The Letter from the CFO was posted under the Certification of Financial Responsibility section of CERS.
All documents under the Letter from the CFO section are outdated. Outdated previously submitted documents
should be discarded from the submittal if they are no longer being used to meet the UST requirements, and a
current submittal should be made under each section.
Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate ($152). To schedule an
appointment, please call (209) 468-3420.
Documents provided: Return to Compliance Certification form, schedule of free CUPA classes
FA0003954 PR0231141 SCO01 03/08/2019
EHD 23-01 Rev.09/22/16 Page 5 of 6 Underground Storage Tank Program OIR
