25 November 2008
AGE-NC Project No. 02-0962
Explanation of Why Van De Pol Enterprises Believes the LOC Suspension is Inappropriate
• Van De Pol Enterprises has multiple ongoing investigation and remediation sites. With the
expected delay in reimbursements from the USTCF, the financial burden to maintain the
non-suspended LOC sites will be difficult. The addition of costs generated in regards to the
subject site — with reimbursement suspended creates an unfair burden on Van De Pol
Enterprises.
• Additional investigation is required at the site. Van De Pol Enterprises will be unable to
continue investigation (and monitoring) at the site without timely reimbursement from the
USTCF.
Van De Pol Enterprises Desires the LOC Suspension Be Lifted and Funding Be Expedited
• Van De Pol Enterprises desires to maintain a good working relationship with both the
SJCEHD and the Regional Water Quality Control Board and proceed with investigation and
monitoring at the site. Lifting of the LOC suspension will allow Van De Pol Enterprises to
continue investigation and move the site towards closure.
If you have any questions or require further information, please contact our office at(209)467-1006.
Sincerely,
Advanced GeoEnvironmental,Inc.
Robert E. arty
Vice President
cc: Mr. David Atwater, Van De Pol Enterprises
Mr. Mike Infurna, San Joaquin County Environmental Health Department
Advanced GeoEnvironmental,Inc.
