Six year old grandson son consumed it same day and became extremely ill. (c) states <br /> majority of the yogurt in the store doesn't have expiration date. (c) has pictures of expired food and food with no expiration <br /> dates taken 09/03/15. Child was taken to emergency room same night and doctor stated child had food poisoning. Child <br /> also has high fever. (c) spoke with store manager over the phone. Please contact complainant with findings. <br /> VIOLATIONS AND CORRECTIVE ACTIONS <br /> Items listed on this report as violations do not meet the requirements set forth in the California Health and Safety Code commencing with section 7; <br /> 113700.All violations must be corrected within specified timeframe. Violations that are classified as"MAJOR"pose an immediate threat to public health <br /> and have the potential to cause foodborne illness.All major violations must be corrected immediately. Non-compliance may warrant immediate closure of <br /> the food facility. <br /> #7 Hot and Cold Holding Temperatures Major <br /> OBSERVATIONS: Display Walk In cooler at 62F, and internal temp of various foods within: low fat milk 55 F, yogurt 56 F, <br /> sour cream 51 F. Provide 41 F or below for PHF. Managers are aware of complaint. They stated (c) called about the incident and threatened to sue them. <br /> Store asked for receipt or the actual product but(c) does not have them. (c) did not ask for compensation. <br /> Measured at 12:30 pm Display Walk In cooler at 62F, and internal temp of various foods within: low fat milk 55 F, yogurt 56 <br /> F, sour cream 51 F. PHF has to be 41 F or below. <br /> Marvin stated he received the notice to service the Walk In for water leakage problem yesterday. Marvin arrived at the Walk <br /> In at 10:52am based on C.C. video recording which I viewed, though the recording does not include the digital thermometer <br /> display of the Walk In. Marvin stated it read 37 F. <br /> Observed disposal of half-gallon size milk and all the yogurt. Agreed sour cream need not be disposed since 50 F (+- 1 F) is <br /> considered minor.Collected two Yoplait yogurt red and blue tops after speaking to (c). <br /> Reinspection in 1 week.
