Each aboveground <br /> container shall be tested and inspected for integrity on a regular schedule and whenever repairs are made. The <br /> qualifications of personnel performing tests and inspections,frequency and type of testing ting and inspections that <br /> take into account container size, configuration, and design shall be determined in accordance with industry <br /> standards. Examples of these integrity tests include, but are not limited to: visual inspection, hydrostatic testing, <br /> radiographic testing, ultrasonic testing, acoustic emissions testing, or other systems of non-destructive testing. ... <br /> You must keep comparison records and you must also inspect the container's supports and foundations. In addition, <br /> you must frequently inspect the outside of the container for signs of deterioration, discharges, or accumulation of oil <br /> inside diked areas.. Immediately inspect the interstitial space of double walled tanks, or provide equivalence as <br /> allowed by CFR 112.7(a)(2). <br /> This is a Class II violation. <br /> 718 CFR 112.8(c)(11) Failed to locate properly or provide sufficient secondary containment for mobile/portable <br /> containers. <br /> 55 gallon drums were observed with insufficient secondary containment. The drums were observed on spill pallets <br /> but five drums were observed on pallets meant to hold 4 drums. The drums on the edges of the pallets were not <br /> fully contained within the spill pallets. A 55 gallon drum mentioned in the SPCC that is used to collect oil from used <br /> oil filters does not have secondary containment addressed int the SPCC plan. Portable oil storage containers must <br /> be positioned or located to prevent a discharge and shall be furnished with a secondary means of containment <br /> sufficient to contain the capacity of the largest single container with sufficient freeboard to contain precipitation. <br /> Immediately provide sufficient secondary containment for this and all other portable containers at this facility, or <br /> provide equivalence as allowed by CFR 112.7(a)(2). <br /> This is a Class II violation. <br /> 4010 The Substantial Harm Criteria form was not found onsite. If the owner or operator of a facility determines pursuant <br /> to paragraph (a)(2)of this section that the facility could not, because of its location, reasonably be expected to <br /> cause substantial harm to the environment by discharging oil into or on the navigable waters or adjoining shorelines, <br /> the owner or operator shall complete and maintain at the facility the certification form contained in appendix C to this <br /> part and, in the event an alternative formula that is comparable to CFR 112.20(e) One contained in appendix C to <br /> this part is used to evaluate the criterion in paragraph (f)(1)(ii)(B)or(f)(1)(ii)(C)of this section,the owner or operator <br /> shall attach documentation to the certification form that demonstrates the reliability and analytical soundness of the <br /> comparable formula and shall notify notify the Regional Administrator in writing that an alternative formula was used. <br /> Fill out and retain the Substantial Harm Criteria form. <br /> This was corrected on site. <br /> This is a minor violation. <br /> Overall Inspection Comments: <br /> Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br /> documenting the corrective actions that have been or will be taken for each violation, and any supporting <br /> FA0003775 PR0515676 SCO01 03/14/2019 <br /> EHD 28-01 Rev.09/27/2018 Page 6 of 7 Aboveground Petroleum Storage Act OIR <br /> 1868 E.
