The outside of containers is not frequently inspected for signs of deterioration, discharges, or accumulation of oil. Facility personnel stated that the interstitial space of the double walled tanks is not inspected. Each aboveground container shall be tested and inspected for integrity on a regular schedule and whenever repairs are made. The qualifications of personnel performing tests and inspections,frequency and type of testing ting and inspections that take into account container size, configuration, and design shall be determined in accordance with industry standards. Examples of these integrity tests include, but are not limited to: visual inspection, hydrostatic testing, radiographic testing, ultrasonic testing, acoustic emissions testing, or other systems of non-destructive testing. ... You must keep comparison records and you must also inspect the container's supports and foundations. In addition, you must frequently inspect the outside of the container for signs of deterioration, discharges, or accumulation of oil inside diked areas.. Immediately inspect the interstitial space of double walled tanks, or provide equivalence as allowed by CFR 112.7(a)(2). This is a Class II violation. 718 CFR 112.8(c)(11) Failed to locate properly or provide sufficient secondary containment for mobile/portable containers. 55 gallon drums were observed with insufficient secondary containment. The drums were observed on spill pallets but five drums were observed on pallets meant to hold 4 drums. The drums on the edges of the pallets were not fully contained within the spill pallets. A 55 gallon drum mentioned in the SPCC that is used to collect oil from used oil filters does not have secondary containment addressed int the SPCC plan. Portable oil storage containers must be positioned or located to prevent a discharge and shall be furnished with a secondary means of containment sufficient to contain the capacity of the largest single container with sufficient freeboard to contain precipitation. Immediately provide sufficient secondary containment for this and all other portable containers at this facility, or provide equivalence as allowed by CFR 112.7(a)(2). This is a Class II violation. 4010 The Substantial Harm Criteria form was not found onsite. If the owner or operator of a facility determines pursuant to paragraph (a)(2)of this section that the facility could not, because of its location, reasonably be expected to cause substantial harm to the environment by discharging oil into or on the navigable waters or adjoining shorelines, the owner or operator shall complete and maintain at the facility the certification form contained in appendix C to this part and, in the event an alternative formula that is comparable to CFR 112.20(e) One contained in appendix C to this part is used to evaluate the criterion in paragraph (f)(1)(ii)(B)or(f)(1)(ii)(C)of this section,the owner or operator shall attach documentation to the certification form that demonstrates the reliability and analytical soundness of the comparable formula and shall notify notify the Regional Administrator in writing that an alternative formula was used. Fill out and retain the Substantial Harm Criteria form. This was corrected on site. This is a minor violation.
