Manifest numbers 010198307JJK (8/9/13), 012786060JJK(8/19/14), and 012778038JJK(11/11/14)were found without a signed off copy from the destination facility. Hazardous waste generators shall retain copies of all manifests signed off by the destination facility on site for three years and have them readily available for review. If the generator did not receive a copy of the manifest with the handwritten signature of the owner or operator of the facility to which the generator's waste was submitted within 35 days of the date the waste was accepted by the initial transporter, the generator shall contact the transporter and/or the owner or operator of the designated facility to determine the status of the waste. If the generator did not receive a copy of the signed off copy of the manifest within 45 days of the date that the waste was accepted by the initial transporter, the generator shall submit an Exception Report that includes a legible copy of the missing manifest, and a cover letter signed by the generator explaining the efforts to locate the hazardous waste and the results of those efforts. Exception reports shall be submitted to: DTSC Report Repository Generator Information Services Section P.O. Box 806 Sacramento, CA 95812-0806 Immediately locate a copy of the missing manifests or prepare and submit an exception report to DTSC. Submit to the EHD a copy of the signed off copy of the manifests or a copy of the exception report submitted to DTSC. This is a repeat violation, Class 11- 301 CCR 66265.31 Facility not maintained to minimize the release of a hazardous waste. Sand blast media was observed outside the sand blast room at both doorways, one leading into the facility and one leading to the outside. According to Mr. Lumpkin, the sand blast media on the floor in the facility will be swept up with the floor sweep each day. The sand blast media is left on the floor of the sand blast room and is shoveled into the blaster for reuse as needed. Disposal records on site indicate sand blast waste is being disposed of as hazardous waste. Facilities shall be maintained and operated to minimize the possibility of a fire, explosion, or release of hazardous waste to air, soil, or surface water which could threaten human health or the environment. Immediately clean all sand blast media that is not inside the sand blaster, and manage according to Title 22 hazardous waste regulations. Take all necessary steps to prevent the sand blast media and any other hazardous wastes from being released to the environment. Submit a statement and supporting documentation explaining how this waste was managed. This is a repeat violation, Class II.
