Von Flue <br />RE: Notice to Comply <br />Mr. Von Flue, <br />This letter is to inform you that I have corrected the majority of notice to comply that you have <br />issued. But in some cases I am requesting if you can extend the remaining notice to comply for <br />2 or 3 weeks more to complete. <br />Here is the update on the notice to comply: Building 107 Val Dervin Parkway <br />#12- Maintain the facility to minimize the release of a hazardous waste: The secondary <br />containment in the closed hazardous waste treatment area contains residual waste. Correct <br />immediately. <br />Corrective Action Taken: I have cleaned and collected around the secondary containment area <br />and put into the proper barrels, that are labeled and ready for shipment. <br />#19- The following hazardous waste were onsite longer than 90 days without a permit or <br />authorization: a thru h <br />Corrective Action Taken: All barrels are closed, sealed and ready for pick-up during the week <br />of the 13th. I will send you signed copies of the manifest as soon as they pick-up all the barrels. <br />#20- All of the following containers of hazardous waste were not properly labeled.- See #19, a -h, <br />above and (3) — 55 gallon drum containers located in the paint storage room had insufficient <br />information on the labels. The following information needs to be on a labet: the words <br />"Hazardous Waste", Name, Address, Accumulation Start Date, Composition, Physical State, and <br />Hazardous Properties. Correct immediately. <br />Corrective Action Taken: All labels and barrels has all the necessary information that you have <br />indicated. <br />#21- All containers of hazardous waste need to be kept closed at all times except when adding <br />or removing hazardous waste. The following containers were not closed. See #19 h, above. <br />Correct immediately. <br />Corrective Action Taken: All hazardous waste are now properly closed. <br />#25 and #29- Generator manifest copies not sent to the Department within 30 days and Failed to <br />file and exception report: <br />Several "blue" copies of manifests were found in the records. Mr. Briones stated that he made <br />copies of these forms and sent them to the Department.
