COMPLAINANT WENT INTO DELI ON 6/6/17 AND <br />SEEN THIS DOG. ALSO WITNESSED A CUSTOMER ALLOWED TO BRING THEIR DOG INTO STORE. BELIEVES TO <br />BE UNSANITARY." <br />DESCRIPTION OF COMPLAINT ALLEGATIONS <br />VIOLATIONS AND CORRECTIVE ACTIONS <br />Items listed on this report as violations do not meet the requirements set forth in the California Health and Safety Code commencing with section 7; <br />113700. All violations must be corrected within specified timeframe. Violations that are classified as "MAJOR" pose an immediate threat to public health <br />and have the potential to cause foodborne illness. All major violations must be corrected immediately. Non-compliance may warrant immediate closure of <br />the food facility. <br />OVERALL INSPECTION NOTES AND COMMENTS <br />No Temperature Data Collected <br />FOOD ITEM -- LOCATION -- TEMP º F -- COMMENTS <br />NOTES <br />Upon arrival, no dogs were observed in the facility; nor were any dogs behind the counter. Unable to verify. <br />For informational purposes: Section 113903 of the Health and Safety Code states: "Service animals are dogs that have been <br />individually trained to do work or to perform tasks for the benefit of an individual with a disability, including a physical, sensory, <br />psychiatric, intellectual, or other mental disability, or that is in training to do that work to perform those tasks." <br />According to the 2010 ADA requirements, a food facility operator can ask the following questions to determine if a customer <br />has a legitimate service animal: <br />1) Is this animal required because of a disability? <br />2) What work or task has this animal been trained to perform? <br />If the customer gives credible answers to these questions, the animal is a service animal under ADA. No documentation is <br />required. <br />Service animals does not include any other species of animals-dogs only. <br />Continue to exclude all animals from the food preparation areas. <br />The person in charge is responsible for ensuring that the above mentioned facility is in compliance with all applicable sections of the California Health and <br />Safety Code.
